If Michael was and is unable to recall what happened, what is the basis for his pleading self defense?

Off the top of my head I would say loading a gun with only 2 bullets is a huge indication of intent being one of bringing the gun just in case. Were I going to kill 2 people I would have certainly loaded the full clip.

Then we have the alleged timeline where in LKs version, she beat a man for 7 minutes in the head, she twirled, she looked at multiple phones all after being shot twice at point blank range center mass, flatlining twice later.

We don’t even see The Arnold doing that in a movie.

Re reasons to bring a weapon that you just grabbed, not knowing it only has two bullets in it…

There’s the incident the previous day (?) in which LK bum rushed him and wouldn’t let him get in his truck to retreat also.

There’s also the possibility that he was going to what he assumed was an empty house, since I’ve seen no evidence that he was informed that the Town Inspector allowed LK and RG to stay, to do a number of things… Including self harm.

Which is why both @ekat and I have kept saying that the civil trial is all new and none of the previous is relevant.

Serious Question. So this means all is up for questioning and exposure for both sides now? Rehash the verdict…both sides ? His “I don’t remember anything”? All her social media comments. His actions and any past behavior, emotional issues that might be relevant. Understand there were certain protections in place for both the victim and the one accused in the criminal trial….but not in a civil trial?
Going to get uglier.

Since the evidence (what little there was in the criminal trial) showed literally nothing definitively, if Schellhorn was aware of any previous violent behavior by Michael Barisone, I guarantee he would have used it.
But we do know of violent previous behavior by both LK and RG that Taylor would not allow the jury to hear. They WILL hear about their lengthy criminal records in the civil trials (regardless of convictions - to be charged certainly shows intent).

Someone please show me the absolute evidence Michael Barisone shot anyone…evidence that could not be attributed to Lauren Kanarek or Robert Goodwin’s impeached testimony. Simply saying she was shot is meaningless. If this is so cut and dried by a couple of argumentative posters, why are the Kanareks refusing to comply with subpoenas and requests for depositions that would prove their version of what happened?

How interesting it will be (to all) if Michael regains his memory during his treatment at Greystone. If Simring couldn’t help him remember, I doubt his memory of the horror he suffered that day will ever be recalled, regardless what Taylor and others think.

None of us knows whether he shot her or not. Most of us don’t want to believe one way or the other; we just recognize there is a staggering lack of physical evidence supporting the LK / RG version of events, and there are a number of other equally plausible scenarios.

It’s easy to breezily say that “there are a number of equally plausible scenarios”, but a lot harder to describe even one such scenario.

It’s not hard at all. And I have. And others have. And we did it using elements of the case. But you never pay attention.

Apparently Bilinkas was not paying attention either. Even a single “equally plausible scenario” fitting “the elements of the case” would have provided a basis for reasonable doubt and resulted in straight NG on all four counts.

But she also thought she had gone in a helicopter to the hospital. With being shot twice at point blank center mass(something we do know happened) perhaps she was in shock, she lost a lot of blood and could have be a bit delusional afterwards . I would not put much weight into those comments as far as evidence she was lying about what happen before she was shot or who shot her if brought up at the civil trial.
