MB Civil Trial: JK/KK Contempt of Court?

IIRC, it wasn’t RG that went to the Rock at night to smoke and converse with Mr. Davidson (the hay guy). It was either JH or Mark (?) - can’t remember which one, but definitely not RG.

Yes, it was the Mark guy along with the hay man. The Mark guy lived in the little trailer on the property as I recall.

Me too! And you don’t want doors opened with this type of litigant! Keep the case laser-focused, because there is a pit of eternal stench just outside the edges.

The criminal case did that, and we all saw how much of an effort was required by the judge to keep things out of the muck.

I too would love to hear from someone with more tech knowledge.
The way I have always understood it, sweepers only pick up transmitters, not straight recorders and I think Lauren Kanarek had straight recorders all over the place.

Financial question…LK’s “wealth”…how would it be protected in a suit? The FL house is protected because of FL laws, but if LK has money of her own that daddy controls, wouldn’t it be subject to suits? Would her horses be protected assets?

It’s all very case specific, so without details the answer could be anything from, she loses it all but the house, to she loses nothing. Most homestead laws protect a certain amount of personal property and percentages of income. So how it’s all held will dictate.

What I find interesting, is if JK is found liable, I believe someone here said he owns half the FLA house, there is no protection for HIS share as that isn’t his residence.

Unless he can prove he lives there 6 months of the year.

Excellent point that Nagel’s approach was a HUGE tactical error.

I hope he is working on pure contingency b/c they are certainly getting what they paid for then.

Those may be the flimsy reasons the plaintiff who chose to initiate the case and then relocate is giving but I’m of the opinion those reasons are a ruse to keep her from having to interrupt her and her employees schedule of drugs, horsies, pool, naps.

If you can ride 4 horses in Florida heat (even in morning) and you don’t worry about showing at your scheduled time to ride at peak heat, you are fine to sit in a car and travel. Or with her money she can fly first class where there is distancing.

Remember this is all a game to her, a constant pushing of boundaries to see when she can win or get away with or who she can fool IMHO.

FWIW, I am probably more cautious than most about COVID, and while I wouldn’t be thrilled with flying, I would be perfectly fine to drive with a stash of N-95s. I would probably insist on distancing and ventilation in the conference room if at all possible, and would probably slap a fabric mask over my N-95. That said, she doesn’t seem to be nearly as cautious as I am given her behavior in the court room at the criminal trial and the “festivities” indoors afterwards.

ETA: I still mask indoors everywhere except the barn… and am rethinking going unmasked indoors even there.

I’m guessing they will all be living there as NJ doesn’t seem to have any such protections. Especially if KK is added to the suit.

I mean, this could be potentially financially devastating to the Kanarek family. And that doesn’t make me glad; it’s a huge, important lawsuit that was filed by their daughter that could ruin their financial future and security in their later years.

To have LKs lawyer filing flippant and deficient motions does not bode well for the outcome.

Edited to add that they, JK and KK don’t seem to be taking this seriously by not responding to the discovery requests and the subpoenas just boggles the mind

It really does boggle the mind!! Why on earth would they not respond? Are there any valid reasons?

Yeah, that would fall under my possibility #1 - i.e., the “Seeker1” user account was actually created by KK, using her own actual email address.

And it could also be that KK actually created the Seeker1 user account, but her login credentials are being used by another party who somehow gained access to them.

At any rate, Mods have confirmed that per their investigation, the Seeker1 account is linked to KK, so I am going to assume it really was KK making those postings.

And whether it was or was not actually KK doing the posting, she should have responded to the subpoena in time to prevent being at jeopardy of found in contempt of court.

I think in all likelihood Seeker is who they purport to be and that they may be now deeply regretting their participation in these threads.

Hut-Ho is correct. I was pointing out that beyond the surface arguments, both lawyers wove in some not particularly subtle jabs.

Deininger— On the surface, ‘Look, she’s partying in a hotel in NYC, so not terrified to live life’. But it’s not random that he chose to portray the partying with the middle finger pose. He used the main argument to take the opportunity to say she can be crude.

Nagel — He requests deposition by zoom for the absolutely obvious and generic reasons that it’s more more efficient and cost effective. Nothing to do with LK specifically. But then throws in a sentence or two to the effect that possibly she’s at more risk from Covid infection due to the damage to her lungs … caused by the gun shot wounds… caused by the defendant…, for which he escaped criminal liability…due to the insanity.

Short of having had an incapacitating medical event moments after being served, no, I can’t think of any.

That’s not to say they won’t trot one out and that the judge may admonish them but not fine them is another issue.

This!

There really is no excuse for not responding to the subpoena. None.

(Who came up with the freaking spelling of subpoena, such a weird set of letters.)

Not how I read it.

(Used to be two words - sub poena - that meant under penalty. Because I am a nerd.)

Sure, but you listed it backwards. Nagel was the one who’s started the slinging without offering anything to support his claims.

Denninger then walked through that door, saying, “yeah, look at how sick she is! She’s so feeble she can only lift one finger!”

Both are doing it, yeah? But only one is doing it well.
