He may be doing this very reluctantly, especially at this point. However, no lawyer with even a modicum of professional standards and pride would have let that document go out their door. Not responsive, not well-argued, no supporting evidence at all, inaccuracies as to background facts, and filled with typos and grammatical errors. And, no, pointing those out doesn’t make someone a ‘grammar nazi’. This is a written-word based profession and our written work product, like a book or newspaper article, will and should be scrutinized on all levels. If you cannot catch a typo, how is your client supposed to feel comfortable that you can catch all legal issues? Details matter. And, as SGF’s filing clearly shows, that logic held true: their writing was bad, sloppy, inadequate and, lo and behold, look, their legal reasoning and supporting evidence was also wholly lacking. Nagel did himself a huge disfavour allowing that document to be out there in the court system available for all to see.

As far as LK’s word salad attempt to mock myself and vxf111, I believe her top 5 global blue chip law firm that she claims to have on speed dial is for her anticipated suit against the USEF and SS if/when things don’t go her way there. Yes, it’s a disgusting waste of time and resources for an entity that is meant to be protecting children from sexual exploitation, but that wouldn’t bother someone like the KKlan.

Finally, I believe someone posted that her sister married someone she was involved into recruiting into a firm that she works/worked for as part of HR (the recruiting department). That firm is a perfectly fine, respectable firm. It is not even close to US top 5 let alone global top 5. That is not a knock on the firm - it’s a perfectly respectable firm. It’s just not as prestigious as top 5 in the global rankings.

However, it also is literally my job to catch them in the professional setting before sending them out to a client or opposing counsel - Lord help me if I sent them to the court system!!

Has a lawyer ever acted intentionally badly so that if his client didn’t prevail that client could claim insufficient representation and get the decision appealed or reversed?

Their thinking might bw if that happened the opposition may not have the stomach or resources to start over.

One lesson this whole unfortunate melee has taught me is to listen to the red flags, trust my intuition and hit the road rather than deal with narcissists.

I think most of us have had dealings with some shady characters in the horse world. I’m my case, I had a tight budget which was getting stretched thin with NQR lameness. There are not many barns in my area, so when I found x do-called “trainer” who claimed to know exactly what would “fix” my horse I thought I was lucky.

I was not.

It’s a long story, but it ended with my horse developing laminitis under her husband “farrier”s care, and me giving notice and paying a full 30 days and taking my horse out at 4am the next day. She enjoyed hurting people that she thought wronged her. She was the hero in her own story even though no one knew about her or gave one whit what she did.

I don’t know why the horse world seems to attract these types, but this trial showcases why its no badge of honor to put up with the “difficult types” when a situation starts to smell of rotten fish, don’t add more lemon to the fish. Throw the damn thing in the trash and be glad you didn’t give yourself food poisoning by trying to eat it.

Still catching up on today, but going back to Nagel’s motion if I may. He states that MB was found guilty of attempted murder. Period. That is a lie. Can there be repercussions for him lying like this in a legal document?

I’m not sure you get the same deference with ineffective assistance of counsel in a civil suit, as you can presumably fire the attorney any time. Though it may mitigate what you get heard on appeal if the attorney didn’t properly preserve the issue below.

Again, an attorney who doesn’t like the client should just fire them and get gone.

Well with criminal trials you can get the scenario of “young innocent kid got a life sentence because the public defender was incompetent but now we’re appealing with a hot shot lawyer paid for by donation.”

But I can’t see how that would work where you the plaintiff choose to go to court, choose your lawyer and choose every step of the way to continue and not settle or withdraw. And in a civil case if you mess it up badly enough you aren’t allowed to try again.

I can’t actually imagine a scenario in crime or civil law where you’d strategically want to lose so you can then launch an appeal.

I totally agree! You can be sure the client will lose if the accused of ineffective assistance attorney is the one handling the appeal! Especially in a case where there is a choice of attorneys

If someone can ride four horses in a day in the FL heat plus do Pilates and strength training (which was mentioned in her YouTube comments that I can no longer locate), how much has her “medical condition” really suffered? Previous to the shooting, was she riding 5 horses a day? /s

Seriously, if I were a lawyer and someone approached me about representing them, before I would agree, I would do a little research on the individual. In this case, the research would have taken me to the criminal trial coverage of Law and Crime and LK in all her glory as a witness. Yeah. No. Not taking her as a client.

I agree that there is no way this would happen. In addition to all the good points already made above, you (i) wouldn’t want a public record of your status as ineffective counsel, and (ii) you’d open yourself up for a malpractice suit which would likely get your malpractice insurance cancelled after resolution of the situation and make it very hard to get coverage elsewhere.

Can they do search warrants in Civil Trials? If they aren’t getting their material, say, if they think something’s in the house they claim they don’t possess? Things like that?

IANAL but my guess is “no”. Search warrants are sought when a crime has been committed.

But let’s look at it this way…if Bruce is friends with Jonathan and like has been theorized so many times (because heck, there has to be a reason) Jonathan has something he can use to control Bruce, then Bruce can not just withdraw. Add in that I am sure Lauren Kanarek is not the easiest person to represent. If she deals with every day life like she posts on the internet she has to be close to impossible to represent, actually.

My specialty is thinking faster than I am typing and leaving out words, adding words, using totally wrong words. I go back and read and I often wonder how I proof read that and did not notice that before I hit reply.

Could this be because the answers during that part of discovery were - my paraphrasing - go find it yourself, it is out there?

This made me laugh way too hard. What a wonderful way to explain this.

Thank you for clarifying this. Is it a firm that offers personal injury lawyers?
It just seems weird that if your sister is going to file a personal injury case that is a slam dunk, darn it, she has been wronged, one of the amazing lawyers where their brother in law works would be the first choice.

Bruce was hired before the criminal trial took place.
I think he was swindled into thinking, like he said in that ever so amusing court document, this is a slam dunk case.

Yes, the same type of “I will NOT be rejected” mentality often exhibited by a person with extreme NPD. And coupled with extreme delusions of grandeur, which means they will stop at nothing to make sure they win. “I am SO glorious - and since no one else is even close to being as splendid, I deserve to have whatever I want. And not getting what I want is tantamount to being rejected, and that is a fate too horrifying to contemplate.”

So couple that attitude with long term addiction to opiates, and a family philosophy of borderline shady adherence to the standards and mores of polite society, and what do you get? :thinking:
