Well damn! We need to get word to Michael that in the future he must say, per some absurd poster on CoTH, that he must never wish “everyone health” again. Of course this poster would say something so ridiculous because her icon has never wished anyone health in her life, so to do so must be disingenuous.

Wow, Nagel works in a jurisdiction where a judge can decide motions on the briefs without a hearing and he submitted that crappy brief?

I am not a lawyer, but I really hope that in the long run, this case will result in having much more definitive guidelines for all things related to Krol hearings. It seems like the judge in this case paid absolutely no attention to the required timelines for such things, and I hope he gets raked over the coals for it in the process of firming up those requirements.
And this is just the case we happen to know about, with someone who has the resources and support system of an Olympic trainer. Imagine what happens to all the people who do not have anything like that kind of background to help them?? Very scary thought.

I’d still want to know if she still has the EVIDENCE, and what she purports to have seen. So, I’d send a subpoena. Maybe she’d fight it but I’d still try.

I will say he almost lost me at the beginning when he said it hardly qualified as a sport, but unfortunately that is not an unusual point of view from people who don’t know any better.

I’m no expert on safe sport, but somehow I doubt that would work. Otherwise that would be a very easy out for a lot of people to skip the training.
