I have a question for our brilliant legal minds. Since the Krol hearing I have been wondering about this.
The prosecution’s position was that MB knew what he was doing and even the comments by the judge and CS about how his change in appearance since the trial was different and his appearance at the trial was for the jurys benefit.
How could he then say at the Krol hearing that they agreed with the stay at Greystone, a psychiatric hospital, when they claim he is not insane. How is that not punitive?
I am not a lawyer, but I really hope that in the long run, this case will result in having much more definitive guidelines for all things related to Krol hearings. It seems like the judge in this case paid absolutely no attention to the required timelines for such things, and I hope he gets raked over the coals for it in the process of firming up those requirements.
And this is just the case we happen to know about, with someone who has the resources and support system of an Olympic trainer. Imagine what happens to all the people who do not have anything like that kind of background to help them?? Very scary thought.

I’d still want to know if she still has the EVIDENCE, and what she purports to have seen. So, I’d send a subpoena. Maybe she’d fight it but I’d still try.

I will say he almost lost me at the beginning when he said it hardly qualified as a sport, but unfortunately that is not an unusual point of view from people who don’t know any better.
I have been wondering if action can/will be taken while LK remains out of compliance. And if that is why she hasnt completed the training.
I’m no expert on safe sport, but somehow I doubt that would work. Otherwise that would be a very easy out for a lot of people to skip the training.
