MB Civil Trial: JK/KK Contempt of Court?

@Jillsmith,

If my memory serves, Bilinkas wanted to use self-dense, but the judge wouldn’t allow it. The reasons for not allowing it were actually pretty sound: with little to no forensic evidence and the only first person testimony belonging to witness that were thoroughly non-credible and had a lot of reason to lie about the events, there was no way to mount that defense.

One of things that I said early to people who suggested that MB was faking his amnesia or his mental breakdown was that MB’s amnesia served him not at all, and LK and RG very well. That was not a popular opinion.

LK and RG could make up any version of events that sorta kinda fit the physical evidence in absence of MB to contradict it. The fact that the two of them couldn’t keep their stories straight and contradicted themselves and each other multiple times, well, they’re not criminal masterminds.

Imagine if MB had taken the stand and laid out his own version of events. I think we’re all aware who would be perceived as more credible by the jury.

Out of curiosity how does someone not in the mob decide who is in the mob? Is there a key word that indicates membership?

The members of the Elderly Illegal Mob all have tattoos as identifiers.

And bathrobes.

And basements.

And none of us believe that what happened at Hawthorne Hill on August 7, 2019 happened the way LK and RG say it did.

My quote feature works sporadically on my phone so apologies for the copy/paste.
“ Barisone did plead NG by reason of self defense” your words.
He did not, he plead NGRI which is not self defense. He could not plead self defense as Taylor ruled there was not sufficient evidence to support that plea.

I actually think most of us agreed with that thought. It would have been much easier for Michael to say he remembered what happened.

It was not a popular opinion among a certain faction. The Elderly Illegal Mob faction supported the opinion.

Shell casings, bullet wounds, ear witness, while she was getting shot, 911 call, …

Also the fact that the jury, after assessing the evidence, declined to find him NG as they did with RG.

Ironically the Elderly Illegal Mob has been right about everything so far, right? Well, maybe except for Michael being home by Christmas but we’ll see. Seems forces are in effect preventing him from being moved - yet again. Obviously punitive IMO.

And yet, Barisone did enter a plea of NG by reason of self defense! It must be possible!

I understand perfectly that NGRI is not equal to G.
I understand perfectly that NGRI is not equal to NG.

RG saved everyone. MB had control of the handgun and took it to the site. He escalated the violence. RG restrained the violence to the amount necessary to stop him.

Condoning gun violence is wrong.

RG should be given a civilian hero award. He used sufficient force to restrain MB but not kill after MB shot LK twice.

Even if the amnesia is real, it is alleged to cover a number of hours on Aug 7. There was plenty that MB could have testified about, especially with regard to his state of mind, despite the amnesia. Yet he chose to decline to testify.

I understand they declining to testify in the civil trial CDM be held against him, unlike in the criminal trial.

Re bolded: let’s not forget that Bilinkas tried and succeeded in establishing that MB was delusional, and had him dressed to suit the part.

As I understand it, membership in the mob is by self selection.

NGRI is a verdict where someone has been proven of conducting an act that would otherwise be a crime but the person was insane at the time. So yeah. Proven in a court of criminal law beyond a reasonable doubt that he shot her twice. Dangerous. Institutionalized until he works the levels which may or may not be 6 months, up to him.

He entered two pleas.

NGRI and NG by reason of self defense.

Yes, it does get really tiresome hearing people say he should be excused from shooting her or claiming he did not, blaming her, the judge, LE, etc. because he was found to have committed a dangerous act that would otherwise be a crime except he was insane at the time.

The illegal mob was wrong about MB being found straight NG on all counts. Remember the poll?

This is related to MB not being home by Christmas.

The institutions are full. There is nothing punitive about it.

The elderly mob is wrong and just making excuses by blaming everyone for the violence except the person, MB, who was convicted in a criminal court of law for committing the violent act that would otherwise be a crime except he was insane at the time.
