So many nuggets in the first document, but one that I find interesting is that SGF’s counsel seems to have reached a similar conclusion to many here that the subpoena to testify in the criminal case was not business as usual…
Wow! When you read through the first document, it really does make LK look bad. I like the part where SGF referred to her as “nothing but a trespasser”. I am pretty sure that this whole thing has not gone the way the the LK camp thought it would and are now freaking out that the “truth” may at last come out. The fact that LK brought this suit, in this juristiction, and now won’t come to give her deposition in person speaks volumes. I wonder how the conversations with her and daddy are going now. All of her 14,000+ social media posts may indeed come back to bite her in the ass.
So it will be interesting to see if Kirby follows her daughter’s lead and says she was lying on social media about the recordings and transcriptions. Anyone want to bet?
That line was great. I’m also particularly fond of:
“ Although Plaintiff has cast herself in the role of victim, one of Barisone’s primary arguments at the criminal trial was that whatever happened on August 7, 2019, occurred because Kanarek and Goodwin engaged in a series of actions that literally drove Barisone insane.4”
The footnote #4 says the verdict shows the jury found Barisone’s argument compelling.
I loved this particular filing. They also made a point to tell/invite the judge to watch the criminal trial by pointing out it is all on YT.
The only thing, without seeing the actual LLC documents, I’m not sure that since MB was a partial owner, that their theory of MB not being allowed to let Lk live there is entirely accurate. There might be a bit of a devil in those details.
However, it does seem that SGF is going exclusively after LK in this suit. There does not appear to be a lot of cross fire going on between SGF and Michael, at least not yet.
So, the really interesting thing is going to be just how much do the transcripts differ from what was actually said in the “Bombshell Tapes”.
I mean, we already have a pretty good idea that they probably are very out of context because Seeker said they were bland enough to not be able to “see” the murder plot until after the shooting.
But the one that will be very interesting is just how out of context was the recording of the conversation that she turned over to SS. My theory has always been that she took the gun because it would be the best way to get a 2 for 1 attack in at MHG: her kids and her GP hopeful horse’s half owner.
How does a cross claim work when a case goes to court? Does the party involved, in this case SGF, wait until a judgement is reached and then presents their case, or are all party cases presented to the jury and the jury just gets a massive sheet to fill out for their verdicts?
