I took ballet to fulfill a credit in college. My instructor told me that she felt terrible that I tried so hard but she could not give me an A because I was so awful! Rotate from your hips. I CANNOT DO THAT. I CANNOT. THEY DO NOT ROTATE. This is undoubtedly also the reason I am a much better Saddle Seat rider than anything else. Also why my and Roseyās dressage career was short lived. LOL

My hips are my nemesis, so I can totally relate - to that, and to the A for effort but F for execution!!! I do feel that my hips are better now that I am riding again versus what they were during my hiatusā¦ but they will never be supple!

Fast forward to my modern class, weāre on our backs doing leg stretches: up, out, downā¦ Blam! My leg hits the floor and Iām in agony! It did something where it just dropped from the hip. Since my school also had a pt department, they took a lookā¦ I had a weak ilius (I think it was the iliofemoral ligament) something? Hip femoral anteversion? And my pigeon toed -ness was not my feet turning in, but my entire left leg is rotated in from the hip. . So, Iām a naturally sucky ballerina.

Years ago I was at a dressage show and there was a massage therapist giving free massages. She kept saying how riders were so tight in their hips and we all needed to be looser. Iām thinking to myself well maybe it is the riding causing it.
100%! And have had massage therapists and physical therapists tell me the same. My personal trainer said I was the worst of all his clients, anecdotally!
I briefly took ballet as a child but was removed by my mom for inattentionā¦ or maybe poor behavior.
I can put my heels together and point my toes close to 2:45-9:15. This is not an advantage when riding.

I think the amount of soft tissue damage, muscle atrophy, and scar tissue after those injuries and subsequent surgeries would be substantial. Not life threatening but plausibly life changing and plausibly a source of long term pain, discomfort, and physical limitations. As well there has to be a significant degree of psychological trauma, which must count for something in terms of compensation for pain and suffering.
While I think the pain and suffering part is easily proven, I donāt see much of a case in terms
of her ācareer.ā As someone said above she would have to prove she had a promising career as a competitive rider, and to my knowledge there is no evidence to support that and plenty to refute it. You canāt lose what you never had in the first place. Loss
of enjoyment is tough if she has been able to ride and compete with roughly the same results since the shooting. And of course loss of income / future income isnāt a thing for someone who doesnāt seem to have had any type of regular employment.
So in my non-expert, non-lawyer opinion, injury, pain and suffering, yes. Damage to career / income, no.

Question for @Virginia_Horse_Mom and @ekat, can the jurors in the civil trial decide among themselves that MB acted in self defense and determine his physical injuries were very serious and award him appropriately. Or do the just look at whatās presented and decide who gets money for whatever without explanation from them? Using the Heard-Depp trial as an example, they aired all the laundry about everything! For sure, MBās lost income and other damages since 8/7 can be calculated. Hopefully his ability to resume his career will be without issue.

Having had thoracic surgery myself for cancer I can say that other than the scars I have zero limitations, zero pain, zero effects.
Any effects I have are from chemo/neuropathy. But not in that area.
So there may be significant protracted injury or there may be none or anywhere in between. We just donāt know.

IIRC, there was a medical entity (maybe the treating hospital after the shooting?) that is suing MB for about 25k, I assume cost of treatment. I wonder if this is because his insurance would not provide coverage, or if there was a lack of insuranceā¦ or? I was a little surprised to see it but I guess that may not be unusual?
Hospitals want to get paid, too. Iām surprised no one on his team met with the hospital accounts department to iron out a payment plan. It may have been left to the wayside to be dealt with after the trial.
Yea, I get they want to be paid but Iām wondering if insurance would not cover? To my understanding he had insurance. I would also think there would be a payment plan while he was in jail. Maybe he simply could not afford to pay it with everything else going on and had to prioritize. I have no idea.

My gut tells me this. And then the claim is filed, so, might as well let it wait until after the Krol hearing that keeps getting delayed.
