This sounds like wishful thinking on the part of the Kanarek clan and nothing more.
People with actual legal knowledge have told you the question of insurance is not relevant to the facts of the case, and therefore is not likely to come out at trial. Why do you choose to believe your own wild, uneducated guesses instead?
I believe you, and perhaps one other, are the only ones who ever attempt to post anything positive about the Kanareks. So, don’t give yourself any credit for the tone of disgust about this family. You simply are a humorous, although occasionally annoying distraction. Bottom line is no one cares other than you provide entertainment to the thread.
If the brilliant Mr Silver succeeds in getting SGF excused from
the case by summary judgement, so that there are just two defendants, MB and RC, I think that all three remaining parties (MB, RC, and LK) are in a worse situation.
To the extent you (g) are supportive of MB, it’s surprising to me that people seem to be rooting for SGF to be excused from the case.
Wouldn’t it be fun if the Kanareks behaved like normal, law abiding citizens and responded to legal subpoenas and produced the evidence they all so gleefully admitted having? Their behavior is so queer for presumably innocent victims, isn’t it?
@CurrentlyHorseless this sounds like you are crossing your fingers, “I hope, I hope”. According to I’dratherbe, If there is an insurance company, someone’s got to prove that the IC has any kind of liablilty, if there is an IC, before its ever admitted into evidence in this trial. If an insurance company doesn’t have any liability about what happened on the farm, the jury will never know whether there is or isn’t one. And neither will you. And for your movie, its none of your business whether or not a “deep pockets” insurance company is paying Silver.
Legal peeps: Frankly, why would an insurance company pay the atty fees of a private entity? The insurance company might hire their own attorney to fight their own liability, but so far there is no accusation of an insurance companies’ liability, and no insurance company represented, is there? I could be wrong, but those who are currently clueless about what they are talking about seem to be really fixated on deep pockets of an insurance company which may or may not even exist, and even less likely, may or may not even have an interest in this case, if they do. Why is @CurrentlyHorseless going on about what may be a fictitious insurance company?
I can’t get past the unlikelyhood that the owner of the property is in any way responsible for what happened on it. Its not like there’s any clear understanding of what happened. Just because LK got shot on the property doesn’t make SGF responsible. She could have shot herself, she could have been shot by her boyfriend. There’s no chain of evidence that says what happened, just because the police showed up and found RG Beating up some guy, and choking him out. That doesn’t make SGF responsible for what happened to her, and even less likely doesn’t make their insurance company liable.
If the Ks can’t come up with some proof of what they are claming, looks to me like they are SOL, and any jury could just as well tell them to get lost with their made up story, as anything else. I mean, supposedly they HAVE proof, but so far they refuse to present it. So unless that changes, I doubt no one will ever get so far as needing to even ask about SGF’s insurance policies.
While it’s tempting to assume insurance is a reason to award something to lk, since insurance money is “free” in that it’s from a faceless company, is far from being a sure thing.
Was mb an insured? Since the case has stalled at discovery,we can’t know. Once discovery happens, these questions can be answered, until then, it’s anyone’s guess. But insurance companies are pretty dang savvy, and spectacularly good at getting out of responsibility…
When you said “the bank” here… I assume you mean the flippant answer LK gave when on the stand during the criminal trial in response to the question “Where does Pop Pop get his money from?”
Anyway… Word is that Pop Pop has ties to a few Casinos and is an “Independent Gambling Professional” …
I don’t know how far down that rabbit hole any lawyer would want to go. But it certainly adds another slightly unusual layer to this situation.
If the word you speak of is accurate, then that opens up whole new probable and likely scenarios. And, if true, it’s adds a whole new dynamic to the handling of the case by police.
Your point, @CurrentlyHorseless, is based on you not reading what people are saying correctly.
Mr. Silver is brilliant, his writings are brilliant, and bonus, he bases his writings on facts. Real things.
Not imaginary made up twisted things. Not movies in his head.
In my opinion, the reason people here support Mr. Silver is because of that. Not the reason you have decided to spread about. Mr. Silver is trying to bring out the facts of what really happened at SGF.
I would think that even you, @CurrentlyHorseless, would understand why people are supportive of the actual facts coming out. I would think that you, @CurrentlyHorseless, would also find it difficult to understand why Jonathan Kanarek (@Inigo-montoya) seems to not want those facts to come out. This lawyer is not asking for something that might exist. This lawyer is asking for something that does exist, that he has proof exists. That he has proof was given to Jonathan Kanarek and discussed with Jonathan Kanarek. Facts that are associated with what was going on there.
Legal eagles - the case management order that Sceusi granted yesterday states that the various counsels were supposed to upload a joint letter regarding status of discovery seven days prior to the case management conference on Jan. 12, 2023. So that document was supposed to have been loaded by Jan. 5. Wouldn’t we be able to see it on the list of filings? Am I overlooking it?
And why would Sceusi file an order yesterday for an event that was supposed to take place the previous week?
My guess, only a guess, is that when going thru stuff to make sure all his cases were properly passed along it was realized that this document was never issued.
Which would also explain why paperwork requested in it did not happen.
Or, that type of paperwork is not the type of that would be on the public site for us to see.
Kind of like we have never seen the letter/email that Jonathan Kanarek (@Inigo-montoya) sent privately to the judge. We know it exists, the other lawyers received it, but it is not uploaded for all to see.
