For one thing, if one of your posts is flagged and the mods edit it, you will get a notification from the Mod.

Also, if you see [edit] in a post, it means the mods have edited the post - most likely because someone yanked their chain about something they thought was objectionable.

I think you might be giving some people too much credit, and overestimating their intellectual capacity when it comes to trying to gather intelligence and form a coherent legal strategy that can be used to both make their own case, and defend against MBs counterclaims.

I believe certain posters are challenged to rock the boat, post borderline inflammatory, leading or ridiculously off-base posts hoping for reaction from anyone they consider an “insider” or who has Michael’s ear. I have no doubt certain posters posts are scrutinized looking for snippets of info.

What the Kanareks don’t understand is anyone close to Michael or who know anything aren’t going to behave like them and post anything here. Even the legal eagles are posting speculation on the filings only - nothing more. No one would divulge any known strategies!

I have never gotten a notification that my post was flagged, and I have no doubt many of my posts have been flagged.

The system must have a feature for the moderation to send a notification when they edit or remove something.

Let’s say MB gets released from Greystone in March, but the SafeSport suspension continues on for awhile, and MB has to pay more attorneys’ fees to deal with that.

Do you think he can claim lost earnings related to being prevented from training USEF member students due to the SafeSport suspension, and amy attorneys fees related to getting that suspension lifted as part of his total “actual damages” caused by the illegal wiretapping, and distribution of the related transcripts to SafeSport by LK?

Excellent question. And I would certainly think he would be entitled to claim lost earnings and try to hold LK accountable for it. As to whether he would win on that point, who knows? On one hand, it is pretty much assumed that LK did send SS a fallacious report on MB, for the express purpose of undermining his standing with USEF and thereby destroying his reputation and career. On the other hand, a jury may hold him accountable for committing misdeeds (i.e., the shooting) that resulted in his suspension being upheld.

Her fake report predates the shooting so that act is actionable and requires judgment. The amount may be negated by the subsequent developments but that initial reporting was not just and is deserving of damages.

A horse clearing a 51% “bar” would have indicated the preponderance of the evidence “standard”, and would have been, well, more horsey.

Horses in jumping competitions incur penalties if they don’t clear 100% of each hurdle. They don’t get a pass on a jump if they only clear 51% of it. Since incurred penalties could knock a horse completely out of contention for the win, your horsey analogy doesn’t exactly work the way you think it does.

But do you think any of that hurt MB’s reputation? If it was on 48 hrs maybe. But as many people here continued to stay LK’s actions have only hurt herself, the dressage community supports him. And the dressage community doesn’t believe anything she says anyway. It didn’t hurt him in the criminal trial, having not been presented and as
he wasn’t found straight guilty. Just how much has he been damaged specifically from these tapes? Maybe emotionally being concerned they might come out at some point.

I just can’t. Doesn’t work that way. Stop.

It’s the ACT that’s the problem here, not whether or not it worked as far as liability.

I made a joke earlier referencing a movie.

CH actually referenced the exact same movie (Mean Girls) in earlier Barisone threads in direct conversations with me. So I figured she would understand my joke.

But she now claims she didn’t.

So unfortunate. I think laughter helps ease tension. So I choose to make jokes.

Not the quality of the artwork, the decision to draw a pie instead of a horse clearing a 51% hurdle.

A horse clearing a 51% “bar” would have indicated the preponderance of the evidence “standard”, and would have been, well, more horsey. The pie is great for the division of liability at the end, but not for the clearing the bar at the first stage.

I wasn’t depicting a preponderance of evidence. I was trying to explain how liability and 51% and modified comparative negligence work, and how they are different than damages and the percentage of damages owed by various losing parties. Different things. But thanks for the critique!
