Suspended Charles Town Jockeys File Injunction

This should get pretty interesting. Chief Steward Danny Wright is the biggest p***k in the world. He’ll make the jockey’s life hell for going this route. Should get interesting.


Acting on behalf of seven jockeys suspended by Charles Town Races & Slots for allegedly misrepresenting their weights during races at the West Virginia track, the Jockeys’ Guild on April 16 reported that a temporary injunction had been granted that permits the riders to continue to ride.

According to a release from the Guild, Judge L.D. Egnor of the Kanawha County Circuit Court issued a temporary restraining order that enables the jockeys to continue riding until their case is properly adjudicated. The seven riders are Larry Reynolds, Anthony Mawing, Alexis Rios-Conde, Jesus Sanchez, Dale Whittaker, Luis Perez and Tony Maragh.

The Guild filed the motion on April 14 and was represented by the law firm of Bailey & Glasser, LLP.

According to the Guild, the organization “took immediate action to protect the rights of its members to continue to ride after unfairly being accused of intentionally misrepresenting their riding weights. The Guild also believes that the stewards’ hearing procedure was unfair.”

The Guild statement said the court ruled that “the notices sent to plaintiffs by defendant were facially and constitutionally insufficient; that the manner in which the defendants conducted proceedings against the plaintiffs appears to have violated his constitutional rights to due process in multiple ways; that the injuries caused by the defendant’s actions, including the inability to race, are immediate and irreparable in that monetary damages appear difficult to establish and the public interest is best served when the constitutional rights of public license holders are respected and protected by public agencies.”

“The Guild is committed to supporting its members when they are unfairly accused of violating the rules of racing or not given their proper due process to present their defense,” Terry Meyocks, national manager of the Jockeys’ Guild, said in a statement. “We are thankful that Judge Egnor confirmed the importance of due process rights before any discipline is handed out.”

Charles Town suspended the jockeys 30 days and fined them $1,000 each based on an investigation in which surveillance cameras were used to allegedly detect jockeys carrying more than the assigned weight. Clerk of scales Michael Garrison was fined $1,000, suspended indefinitely, and had his occupational license suspended. According to the ruling issued by the stewards April 8, Garrison was suspended for “failing to use due diligence in the performance of his duty” as clerk of scales and for violating seven rules of racing. He was also found in violation for not testifying before the stewards

Mr. Wright or anyone at the track is not allowed to make the riders life hell as they would be held in contempt of court. The judge ordered a restraining order against the track and PNGI until a hearing. Try as they may, the track is only digging themselves deeper with the stupid little things they are doing to put a damper on the riders and their careers.

So riders fudge their weights by 5 lbs and that is OK? Should they just get a $100 fine?

The last time I checked people do wager on these horses as they race around the track.

WHere is the proof ??? Have you seen the tapes ??? All of this stems from an indifference with the clerk of scales and the racing office. You are only going by what you have read, and what the holyier than thou stewards are saying. The riders have not said anything !!! Justice will prevail in the end…stay tuned…

Great. Can’t wait to hear the defense. Maybe they’ll blame the scale for not being calibrated…

No, Mr. Garrison is indefinately suspended.What happened to innocent until PROVEN guilty !!! As stated before, this is going to be very interesting. Can’t wait for the all the truthes to come out. Oh, and as far as Mr. Wright making the riders life hell for filing the injunction, don’t you think there lives have been hell since these false allegations came forth !!!

Can you provide some sort of insight as to why your husband is innocent? Faulty Camera, setup by others, non-calibrated scale, etc…

For a track to take such definitive action one can be reasonably sure they had pretty concrete proof of the transgressions.

SHe loves her husband so, sure, she’s going to buy whatever line he has fed her.

Me thinks Jessi P has obviously never has any dealings with CTRS.Me thinks that you would think they would have been reasonably sure of their allegations for them to take a definitive action against the riders. However you are all basing your opinions on things you have read. Not on pure facts !!! You think because they say that they have video that you believe what they say. You have not seen the video have you??? They where accused of paying off the cleok of scales…where is the proof in that ??? There is none !!! Nor was there ever any !!!

In looking at some of the other threads you have started, you like to take shots at people.Your obviously not a horseman !!! I’m sure you attend the races faithfully, and because of that think you know what it is like on the backside.

Lovemyhusband I do not race at Charlestown and do not personally know the jocks, have been there for the races a couple times but that’s it. I have however been a licensed owner/gallop girl/trainer/asst trainer since 1987, so years and years on the backside. This is quite a drastic step to take, and from my experience in the TB racing world Charlestown must have had some pretty compelling evidence to levy such charges against the jocks and COS. No dog in this fight myself, just an educated opinion.

As we are all entitled to our opinions, but things are not always what they seem… I understand your thoughts that the evidence would be compelling,however I am tired of reading things that people are basing their facts on by what they read !!! I have never blogged about anything before, but felt compelled to this morning after reading the 1st thread. Now I see why I usually ignore these types of things !!! LOL !!!

Usually what the stewards will do in these types of situations is go down and stand next to the scales when the riders weigh in or out… kind of an easy way to see who’s over or not…then the questions begin.

It happened yrs ago when I was in NE… the clerk of scales lost his job and left town, only to be hired as an entry clerk in Maryland! I really dont remember what happened to the rider that was involved, but she did end up riding again once she “slimmed” down.

I would agree it is hard for us on the outside to know what is exactly going on, so we can’t assume things. I also know that Maragh rode for me at Penn, was very light, but I do think he was recorded as 2 lbs over. (I took the weight allowance with my claim tag- but I could be wrong and he may have been the right weight). I just remember throwing him up and thinking he was light as a feather.

The other thing I would say is CT is NOTORIOUSLY hard to deal with. They make life so difficult and make it so hard and miserable to ship in it isn’t even funny. I had a first time lasix first time starter that had all of her paperwork in order, but they called me morning of race and claimed not to have bleeder cert. I called my state vet who immediately re faxed it. Then, when I was in the receiving barn with my first time starter I got tapped on my shoulder by a security guard who said they didn’t believe I had a badge. Mind you I had run a horse two weeks earlier as the owner/trainer. I had to walk my butt up to the commission office where I showed them the same badge that was hanging on my hip that I had shown the guard. The woman said “but we have no record that you paid for your license”. I went through my purse and 2 minutes later produced the receipt for above license. Went back about my business with no more problems THAT day. That is just one of many instances.
Ct is an interesting place to say the least. But the purses are great. :wink:
