I forget that so many people aren’t familiar with legal matters. As LLPR posted, I didn’t make myself clear when I stated that a warrant could be recalled and that did not mean charges were recalled or dismissed. Also, some people thought it odd that charges weren’t filed against RC until October. That isn’t unusual at all. In some murder cases (no statute of limitations) detectives may or may not know who the perpetrator is, and it could be 20, 30 years or any amount of years until the investigation reveals the evidence to issue a warrant for arrest. The investigation into the handgun and where it was last legally sold may have taken some time. Although some states require registration of a handgun, many states do not. But every state requires a licensed gun dealer (FFL) to fill out an ATF form and submit the identification/application of any person purchasing a firearm. The FFL then submits the information to the National Instant Criminal Background Check System (NICS) electronically or by phone. NICS performs a background check on the buyer, checking for any criminal records or any other reason a person may be ineligible to purchase a firearm. NICS is operated 17 hours a day, 7 days a week. States require various waiting periods before the purchaser takes possession of a firearm.
If any of the serial numbers were obscured on the RC handgun (as alleged in a police report), there are labs where many times they can discover those stamped numbers. If RC bought a used gun off the street or from anyone not an FFL, then it would have taken the investigators some time to run down the various owners, if at all. If it had been attempted to obscure the serial numbers by filing or any other method, the gun may have been used in a previous crime. Anyone who purchases a firearm with obscured serial numbers is an idiot, or knows they may intend to use the gun for an illegal purpose.
