I assume she would be asked to present 5 years of 1099’s, W-2’s, tax returns, whatever would prove she lost income. Certainly Barisone could produce his business records and total loss of income since August 2019 and potential future losses if he can’t build his business back up.
My complaint is that you were saying that **other **posters were writing some “nasty posts” (your words - not mine) about seahorse. I found the thread - Updated barisone lawsuit 10/29/21 post 851 post 2860. People THANKED her for offering her perspective, and asked a few polite questions which she answered. One poster did indeed look up her USDF record, and another poster corrected that initial poster by adding some correct info found via google. Not a single one of those posts were “Nasty.”

Another question… in the summer of 2019 in Long Valley, NJ, if 3-4 stalls opened up at a facility like MBs, how long would it typically take to fill them?
Yeah, that part is pretty formulaic. You have to prove income at the moment of loss, and then they look back for a period of time based on industry, etc. Then if you’re claiming continued loss of future earnings for some period, based on medical records, they project out based on your past. So that number is usually never just random.
Apparently “nasty” is in the eye of the beholder unless they themselves are being nasty

I said nothing if the kind. Did not mention the word “perjury”. It was in the form of a clarifying question, but the nature of the question suggested I had accused someone of perjury.
As I understand it, to be perjury, an untrue statement given under oath must also be determined to be material to the issue at hand. I don’t know whether JK participated in the negotiations or not. I can’t really see how it’s material to whether MB shot LK or to MBs state of mind.

I honestly find that hard to believe. Why would a trainer at that level “solicit” a mediocre ammy? How many horses did your daughter have at the time? She, obviously, approached him. No trainer at MB’s level “solicits” clients. At his caliber, people “flock” to him. I know many people that sought his instruction at that time. He did not seek clients.
The issue is whether Barisone agreed to the deal, not whether it appears like a good deal or a bad deal from his point of view.
If he thought she was not paying enough, he could have said, “as of next month the fee is $3,500 for every horse in training $2,000 for horses not in training plus $1,000 for the apartment.
That’s $12,000 a month in fees or she’s out the door.
If he could have filled the stalls with other boarders for more money, why did he agree to the deal he did?
But let’s say he did “solicit” her in Florida… why would he have “solicited” her, and then they reached an agreement where $5000 per month paid for 2 horses (to start with) in full board, private lessons, living accommodations for two adults and a dog, etc…

The going market rate for board alone for one horse in that area, at a facility like MBs, as of summer 2019? It’s apparently $3500 per month.
Why would MB accept less than that from LK if he truly was cash poor?
