I’ll make sure in future I always use the /s even with sarcasm that should be obvious, Km.

Considering the idea that they were capturing “public” conversations….who would seriously be plotting murder, harm, or any kind of plot against a boarder in front of their locker where they might walk up unexpectedly and over hear?

Thanks so much for providing this link to Mary DeFranco’s relevant testimony.

For anyone who is following this, but doesn’t want to listen to it, here are the key points:

  1. Mary DeFranco testified that there was no bench in the locker area
  2. MD testified she had a private conversation with MHG about tensions on the farm in MHGs office
  3. MD testified that shortly thereafter, LK posted words she had spoken during that concert… VERBATIM… on social media.

Soooo… if MBs legal team now has evidence of an actual recording of that particular conversation… uhhhh… they have evidence of

  1. Illegal recording by LK and RG
  2. Lying under oath about the illegal recording

If the same set of circumstances applies to me Tarshis, and they also have recordings of his private office conversations with MB?

Uh oh. Mary D and Tarshis were both good witnesses. This is a PROBLEM for the Kanarek side in the civil case.

Key portion:

New Jersey’s wiretapping law is a “one-party consent” law. New Jersey makes it a crime to intercept or record an in-person or telephone conversation unless one party to the conversation consents. N.J. Stat. §§ 2A:156A-3, -4. (link is to the entire code; you need to click through to Title 2A, Article 156A, and then locate the specific provisions). Thus, if you operate in New Jersey, you may record a conversation or phone call if you are a party to the conversation or you get permission from one party to the conversation in advance. That said, if you intend to record conversations involving people located in more than one state, you should play it safe and get the consent of all parties.

In addition to subjecting you to criminal prosecution, violating the New Jersey wiretapping law can expose you to a civil lawsuit for damages by an injured party.

CH, I am sorry - this comes across as completely paranoid. Very similar to what YD accused me of when she had cleverly deduced that there was a non-existent cabal of COTHers PMing behind the scenes in order to plot against her. :roll_eyes:

You are the one making those accusations, ergo it is up to you to prove it and present evidence supporting your claims. On what basis are you making these accusations? Where is your evidence to the evil “coordinated approach” that you insist is going on?

Do you have some sleuthtastic ability to see everyone else’s PMs so you know can demonstrate this to be a fact? No, you don’t.

How on earth would I have access to your PMs? Seriously, how? You suggested that - present evidence to back up your concerns.

This is also similar to NP’s claims that evil COTHers (fat ones sitting in their bath robes at their keyboards who had never even ridden a horse) somehow influenced respected dressage judges to score him lower on his tests than he actually performed…

That was ridiculous. So is the idea that other posters PM back and forth and “coordinate” attacks against others via PM.

You mean if the mods gave me access to the pm accounts of all users? I’m confident they would not breach confidentiality like that, but, yes, that is what would be necessary to prove the negative that @smoofox so blithely asserted.

Those negatives are so darn hard to establish! Why bother!

I don’t need it proved of disproved. Everyone is free to interpret KMs post as they wish.

never mind that the core of the Cabal has hidden profiles, you can’t just send them a PM…

Correction…MB and his team have had it all long. That was how the defense knew to ask about it.

What you are looking at now is that the other parties in the civil suit now know the depth of the discovery that was available to MB. I assume the prosecution didn’t share all of it’s material with LK and it is an eye opener as to what MB has had access to all this time.

Remeber the strident assertions that MB lied in his pleadings in the various civil suits?

Well… I would think that could be part of the civil litigation.

A lawyer could argue that one party was using illegal recordings to try and intimidate and slander another party.

A lawyer could also argue that clients like Ms. DeFranco were alarmed when they realized there private conversations at MBs farm were being recorded, and a crazy woman was publicly posting them on the internet. And, as Ms. DeFranco testified… she was considering pulling her horses from MBs facility.

Guess what that equals? Financial damages to MB. As a result of illegal recording and harassment perpetrated by LK.
Just saying. Maybe MBs lawyers won’t pursue it… maybe they will. Hard to know. We will just have to wait and see I guess…

Exactly! It’s the eye-opening factor that now all sides know what MB has had all along that makes me wonder about the distress we’ve been seeing.

The wiser choice would have been Ocala. Still in FL but not in the same neighborhood as MB. And it is going to give Wellington a run for its money, and is a far better location, esp. for lowly amateurs.
