He would have had to recall JH back as his witness on direct, as that statement wasn’t in evidence when JH a was on the stand. Probably he decided it wasn’t worth it to fly that guy back from Florida to say, nope, never stole her phone, twice on separate occasions.

Well, if you know what perjury is you know that it’s not body language that’s a little off!

If the prosecution had rehearsed cyber testimony of LK and RG to make sure any honest discrepancies had been smoothed out, that process would have been an act of dishonesty prejudicial to Barisone.

I think what was presented on the stand, complete with the typical faulty recall of eye witnesses was honest; carefully rehearsed testimony would have been less honest, even if more effective for the prosecution.

Oh, that’s right, I did do a jaw drop when he said that. I wonder if the Jury caught that. I would be surprised if they didn’t

There are plenty of people who use that same approach to show hunters, jumpers, and equitation.

Speaking of which. Saddle seat is definitely listed under USEF rules in the rulebook. So that might be a little bit of an inaccurate blanket statement.

No, I’m not demanding the prosecution charge her with perjury before I think she lied on the stand.

I want to see evidence that contradicts what she said on the stand.

I think the same, that a totally consistent perfect testimony about the shooting would tell me it was a made-up rehearsed story. It’s why real-life trials aren’t the same as scripted TV shows and movie s.
Real life has people forgetting, making mistakes, misstating and then correcting and elaborating.
There is a very high bar for perjury, it has not happened in this trial.

It was not completely honest. Body language often betrays what is coming out of one’s mouth - even if it does not meet the legal definition of perjury. Why do you always assume that everyone else is stupid or ignorant?

The prosecution did not rehearse anything. LK and RG have been rehashing these events on their own since it happened - one would think they would have at least have come close to agreeing about the events even from their different perspectives - even with the inevitable correcting, misspeaking etc. that we all do. LK offered differing “details” on SM repeatedly… suggesting that what she said on the stand was just the latest version of more SM posts. And we know what she said about her SM posts. She set that standard. No one else.
