I think the same, that a totally consistent perfect testimony about the shooting would tell me it was a made-up rehearsed story. It’s why real-life trials aren’t the same as scripted TV shows and movie s.
Real life has people forgetting, making mistakes, misstating and then correcting and elaborating.
There is a very high bar for perjury, it has not happened in this trial.

Regarding bolded. I’m not a lawyer, but I can totally appreciate that there is a high bar for perjury.

However. We don’t actually know for sure it hasn’t happened.

LKs testimony was impeached. LK is a known liar. Saying that her lies on social media are no big deal… well… that may be true in legal terms…

But the way she lied on social media in basic human terms? It’s bizarre.

The woman is a serial liar.

Was this testified to? Her knowing he had firearms? I don’t recall that. I ride in NJ and I would be SHOCKED if anyone on property had a gun. It isn’t common up north. Giving a gun to lock up (again, questionable decision given MB’s state of mind) doesn’t equal knowing MB had guns.

You might be VERY surprised about the places where guns are, that you have no idea about. I spent most of my life in the NY/ NJ/ PA areas, and more people own guns and/or concealed carry than what you think.

Many carry concealed and others have no idea they do, or that they even own a gun!

I’m not sure I have ever been on a farm that does not have a firearm of some sort. To dispatch a severely injured animal, to dispose of nuisance wildlife, for protection.

Not all of us feel the need to parade our weapons publicly, but it does not mean they are not there.

Not on cross. On cross examination you can only delve into and pick away at what they testified to on direct examination.

But he could have called him as a defense witness and used his own direct examination to follow that line of questioning.

Well, if you know what perjury is you know that it’s not body language that’s a little off!

If the prosecution had rehearsed cyber testimony of LK and RG to make sure any honest discrepancies had been smoothed out, that process would have been an act of dishonesty prejudicial to Barisone.

I think what was presented on the stand, complete with the typical faulty recall of eye witnesses was honest; carefully rehearsed testimony would have been less honest, even if more effective for the prosecution.

It was not completely honest. Body language often betrays what is coming out of one’s mouth - even if it does not meet the legal definition of perjury. Why do you always assume that everyone else is stupid or ignorant?

The prosecution did not rehearse anything. LK and RG have been rehashing these events on their own since it happened - one would think they would have at least have come close to agreeing about the events even from their different perspectives. LK offered differing “details” on SM repeatedly… suggesting that what she said on the stand was just the latest version of more SM posts. And we know what she said about her SM posts. She set that standard. No one else.

I do not think that perjury by LK has been established.

If you were trying to establish that LK had in fact committed perjury, I don’t understand why you would bring up minor discrepancies in recall between her and RG, her needing to have her memory refreshed, or her body language.

I guess I misunderstood your point; perhaps you were not trying to claim she had committed perjury and were simply saying you found her testimony less than forthright.

I still find the fact that she did not conscious design her testimony to fit exactly the prosecution’s narrative or even RGs narrative to be an act of honesty rather than self motivated expediency.

Does anyone know the full list of charges presented to the jury? I believe he was indicted on the two counts of attempted murder (LK and RG?) plus the two possession of a weapon counts. But I know there was discussion of the lesser included offenses, and haven’t tracked the full extent of the offenses the jury has to consider.

So, a couple of threads ago, I did a breakdown of LK’s statements, specifically re: the shooting. I’m not going to repost all of it. I do want to reiterate that quite frankly, I think her 09/19 statement was the most honest and accurate, especially where she was saying things were “shady.” You wouldn’t expect people who have gone through medically what she did to remember things clearly.

But 09/19 was closest in time to the incident.

Here’s one key highlight of the difference between 09/19 and now:

LK stated in 09/19 that - Walked down to him like I’m “miss bad ass” because “I’m sick of everything”, then says She spoke first, loudly, said “how do we fix this, how do we settle Rob…right then he pulled his gun out of the pocket, boom boom, raised hand to Rob on porch and shot at him.

Rob is in the house and she yells at him to not come outside.

LK on Direct exam: - -
[ ] Rob and Mike talked, while Rob was on phone with ED. Heard Mike say “How do we fix this, I don’t want a war.” Rob said to let the lawyers figure it out.

• [ ] Michael seemed calm. Not yelling.
• [ ] She went down to talk to him, Rob stayed on porch, talking to ED on phone still.
• [ ] Walked over to him and said, how do you plan to make things better, started to ask about Rob’s bill when he pulled out a gun and shot me twice in the chest. (At this point she has phone from ED, but doesn’t say when she got it.) Saw gun pulled out, Boom Boom, raises arm to shoot at Rob, Rob disappears.

Now, where I have problems with this is that neither of those versions match ED.

ED says, “I said 4 words to Rob, and he handed the phone to Lauren.” ED doesn’t hear Lauren saying any of the things she says she said in either 09/19 or last week.

And Rob’s version is different than all of the above.

You think that’s minor and inconsequential and just needed memory refreshed.

I’d say there’s a big difference between coming down the stairs, and going up to MB like “I’m miss bad ass” (09/19) and “how are we going to fix this?” (Direct exam) and ED’s version: LK says something like “Micheal just drove up, he’s here”. BOOM BOOM (2 shots) “Oh My God I’ve been shot in the heart!”

And that’s just one example of why I don’t believe any of the three of them.

I thought JH went back to FL after his testimony. If that is the case, he would have had to return to NJ (and be compensated for the travel, I believe). Bilinkas apparently didn’t see the need to compel him to return. Some will no doubt claim Bilinkas was “stupid and incompetent” to not call JH back to the stand, but he didn’t need JH to impeach LK’s testimony when she was doing such a great job of it on her own.
