To me, the sheer lack of injury to RG supports the idea that he was in a delusional state. It really doesn’t appear that MB fought back at all.

ummmm…no in MA you don’t stop at the State Police barracks. LOL. That’s the quickest way to have your guns confiscated …you should just know the laws and keep the gun secured in your vehicle. You can’t transfer certain firearms like a Glock unless you are LEO.
You do need to work with the local police to get a permit for a firearm.

IIRC, the first “recount” of the incident from LK on here said he was on his back, but then I remember later someone said he was on his stomach—maybe that came out in the trial. I can’t remember.

See, that’s something the (non) investigators should have worked out, right? It could have helped build a true story of the incident. I’m trying to envision being in a chokehold and ending up on your back.

I think LK just went with RG’s recounting while tweaking things a bit to her liking.

My thoughts too, but ianal. You’d think introduction of this type of evidence (photo) would open the door to a discussion of how things like that could have plausibly happened. But as with much of the trial, it seems like they weren’t out for the truth but instead just to win. I don’t have much faith in our legal system. Never have.

So I went back and watched the charges conference from Friday and the Judge had mentioned that the jury could find that he was not “insane” at the time of the incident, but that he had “diminished capacity” and therefore acted recklessly. I believe this is where the charge of agg assault comes in. But it also opens the door for the jury to find him not guilty. The Judge even mentioned on Friday that one of the mental health experts had used the exact words “diminished capacity”. My understanding was that was a way for the jury to find him not guilty without having to use insanity. But that was not mentioned anywhere in the jury instructions today. So how will the jury know this?
