If the jury is considering the insanity testimony, they must have agreed Barisone committed the crime. Could be attempted murder and weapons both or just one.
Now they are weighing whether he is legally responsible, again for the separate murder and weapons charges. They could find for or not for both. Or could find one yes, one no.
Did Simring testify Barisone was insane when he got the gun or only when he fired it? Maybe that is why they want to review his testimony…
I agree, the charge for RG is almost superfluous, unless the law provides that firing a gun when someone is present constitutes assault. Like in this morning’s subway shooting, are you liable if you fire a gun with people present even if they aren’t hit?

Sigh… Indeed - and a total Super Star Along with Philip Dutton! They are beyond normal humans… I am mesmerized by the athleticism and then reading about them… and then seeing them testify for MB - WOW! True role models!

Simring testified that Barisone was in a state of psychosis and did not know right from wrong.

My prediction is NG both attempted murder counts or aggravated assault because the state didn’t prove their case no forensics, gsr, dna blah blah

NGBI on the unlawful weapons charge.

Just my opinion folks

I’m rewatching this portion of Simring’s testimony right now. At about the 47 minute mark of the day 8 direct testimony of Simring, he starts talking about MBs mental state. He said MB was “terrified” when he jumped into the car to drive down to the farmhouse, and according to MB, he grabbed Ruth Cox’s pink pistol, because he was afraid he would be killed and wanted to defend himself. MB did it very impulsively, and he was in a state of incredibly high anxiety.

They then talk more about MBs amnesia.

Simring says the most likely explanation for MBs amnesia is that he got hit on the head. Says medical records correspond with this conclusion.

I have to listen further about his testimony regarding the delusional disorder.

:100: It’s really strange for me to want NG for so many defendants we’ve had the past few months.

There are a few regulars who don’t appear to like to read different perspectives. They really, really don’t like it. Good on you for giving it a go, though. I agree with every last word of your comment.
