I did not say the barn should have been abandoned. Obviously the horses were getting their regular daily care while all this was going down in the days, weeks, whatever before the shooting; there is no reason to think that whoever was caring for the horses when MB, LK, and RG were declaring war on each other would not have been able to continue caring for the horses if MB went off to get some much needed psychiatric help for the mental breakdown that several people testified he was experiencing in the days leading up to the shooting.
I can appreciate this comment as well. Except that you replied to me questioning paying RG $50,000 just to get them to leave, the. Trying to sue him to get back $50,000 later.
I’ve listened to the whole trial. Seen the pictures of the farmhouse. Listened to Mike McGrain’s testimony that it was actually him who performed 70-80% of the tile work.
I listened to RG testify that he only did enough work to trade for the extra board expenses for the extra horse, then he stopped working.
I listened to RGs testimony that he “slipped” and used drugs “a few times” in the summer of 2019.
I myself have done substantial renovations on homes and personal barns over the course of the last decade. I have a very good idea of how much various things cost - drywalling, electrical work, etc. For big renovations, and smaller jobs.
And I have seen LKs posts here, from September of 2019, that claim that in August of 2019, MB owed RG $50,000 for work RG had done, and MB didn’t want to pay it, and that was part of the reason for the shooting.
Was LK simply $hitposting again back in September of 2019? Definitely. But… she was also claiming on Facebook in AUGUST of 2019, if I recollect correctly, that RG was owed money for renos, and that is part of why they “couldn’t” leave.
I gotta say… anyone with half a noggin can look at this collection of testimony, facts, and prior social media statements by LK, and deduce that she and RG attempted to shakedown MB for money that RG was NOT owed.
That isn’t because of a lack of contracts, or some sort of fuzzy misunderstanding. That’s because RG has a criminal record, and saw an opportunity, and behaved like a criminal and tried to squeeze MB for cash.
I think MOST people would refuse to make a pay off of $50,000 to a total criminal in a situation like that… because there was no guarantee that even if MB paid, RG and LK would go. They have a record of squatting in more than one situation, I do believe. At least, that’s what I’ve read.
And given the lack of any contract, and the lack of actual work product, and a lot of other details like the lack of a contractors license, etc, RG was never going to win A legal action against MG demanding $50,000 in payment.
I agree he may be a risk, but disagree that jail/remand is the best place for him or doing much of anything to make him less of a risk. If he is declared “not guilty” and/or released for time served, I very much hope he does get suitable help. It is very sad how much time he has spent in limbo. Particularly for a man so used to being outside/active.
This makes things much more clear, at least to me. Someone mentioned selling the horse for $40,000 and a lifetime (or an indefinite period) of free board. This is just such a nutty arrangement, even if it may be well-intended to protect the horse and keep the horse on-property. What if a business deal goes sour? Ditto the idea of bartering rent for labor which may or may not get done. The fact that these people were so untrustworthy obviously ups the ante, but regardless, just sell the horse outright (and add a buyback clause), and have the person pay rent, with a formal tenant agreement, and have the individual work at salary.
If there is any lesson to be learned for other horse people, it’s that NOT having things in writing is ultimately scarier, versus having a contract.
One more story, regarding amnesia. When I was 13 yrs old, I was in the passenger side of a car accident. I never hit my head, I never lost consciousness. This was verified by the other occupants of the car and those immediately on the scene. In fact, there was not a scratch on me, despite the fact that the car hit a telephone pole at a rate of 55mph. It was definitely a bad accident and the car was totaled.
To this day, 30+ years later, I have NO MEMORY of the immediate moments before impact, nothing for at least 20-40 minutes, until after I had been extracted from the car and after I had been loaded in the ambulance.
Mind you, not a scratch on me. Never hit my head, no diagnosis of concussion, never lost consciousness. Those on scene said I was just screaming, over and over. Was it trauma from the event itself? Or did my brain slosh around inside my skull enough to cause memory loss? I’ll never know. Not a second of the incident ever came back to me.
Compare that with MB, who had a hematoma on his head, from being struck about the head.
It is very easy for me to believe he has no memory of what took place. Either through trauma, psychotic break, or injury.
I think that at the point that two years had elapsed since the original trial date, then he would be released. The original trial date was June 2020, so he would be eligible for release in June 2022 if the trial had not taken place.
So saying he didn’t want to be released in June 2022 isn’t that big a deal, given that the trial was scheduled to take place before then.
Simring’s expert testimony is that MB lost his $hit completely when the DCPP worker showed up to question MHG. Period.
Sooooo … if the jury reviews that tomorrow… and believes Simring’s testimony… the decision to get the gun out of the safe and everything that happened at the house? NGI.
What would you have had the court do? Barisone’s lawyer didn’t petition to have him moved to a secure psychiatric facility.
There likely is mental health provided by the jail. Plus, Barisone possibly could have arranged for a private therapist to visit him.
Michael has a sister, Susan Barisone Gilson. Are they estranged or is she among those that are supporting him? I don’t know if she is still riding, but once a long time ago I inquired about a sales horse she had. She was an excellent rider.
Scary! I’m glad you came through it in one piece. Yep, I agree that it’s possible he has no memory of actually shooting LK. I’m listening to Bilinkas’ closing argument and he’s shouting. So distracting. Bilinkas is throwing an awful lot of stuff against the wall. I guess we’ll find out if anything sticks with the jury.
