LK wasn’t leaving because she’s a squatter who knows her rights. Barisone should have had a lease. If she’d violated the terms of the lease, it would have been much easier to get her out. I get it, Knights_Mom – you think that if a person is horrible enough and making someone’s life miserable, they deserve ANYTHING they get. That’s an emotional argument, not a legal argument. I hope all those men on the jury are emotional decision makers for Barisone’s sake. They might just find him NGI, so maybe he will get the help he really, really needs.
I don’t see the purported amnesia from his injuries as relevant to the jury’s deliberations. The amnesia, or lack of it, if we believe the prosecution, does not prove or disprove the claim of insanity before the shooting.
The amnesia is cited as the reason he can’t testify to the particulars of the confrontati on. But the judge has ruled the jury cannot consider self defense based on alternate scenarios. And the defendant’s refusal to testify cannot be considered as indicating guilt or innocence.
My point was that even in the best of circumstances when all parties are honest and well intentioned, if the nitty gritty details are not hammered out and agreed upon, it is human nature that each party interprets the “deal” in a way that is more advantageous to themselves. That’s why real estate contracts are 30 pages long.
Even with the most honest and well intentioned people entering into these deals, lack of detailed, written agreements often leads to very bad feelings when the inherent conflicts which had been submerged by the lack of clarity suddenly emerge.
If you’re dealing with people who are known to try to take advantage, then it’s all the more imperative that everything is spelled out, or else you avoid creating additional financial deals altogether.
One poster, who has since disappeared, said that she had trained with Barisone around 2015 or so, and had a talented PSG horse that MB wanted to campaign himself. She did not agree to his campaigning the horse, and she said Barisone had the horse shipped to Florida without her knowledge or consent anyway. She subsequently took her horse out of training with him. She said she was afraid of Barisone and considered him dishonest. The posts have been erased.
On the renovations, MB was the property owner and principal who decided to skip getting permits, and entered into a sloppy agreement without a written contract with an unlicensed handyman. He’d known LK and RG for well over a year at that point, so would have known of RGs work ethic and drug issues. That’s a situation that anyone could predict would end badly. Most people would not predict that it would end up with someone almost dying, though.
Perhaps they tried to get him out of there but he didn’t want to leave because it was his farm, his business, his problem. And since he is a grown man, I don’t know how they could have FORCED him to leave.
If I truly thought my life and their lives were in danger, yes.
So, if that fear didn’t prompt him to relocate, why would we believe those SAME fears provoked him to get a gun and go shoot someone?
Barisone got himself in the squatter mess. It’s awful. I feel sorry for his predicament, but I don’t believe he had a right to shoot her. Bilinkas argued an insanity defense – because he did shoot her. It was criminal and insanity is their only way of explaining what happened.
Threatening someone (even if they are your tenants) can get you barred from the property.
I had a friend get barred from his property when the deal he had with tenants (which partially included work exchange) went south. The tenants got a court order barring the land owner from the property. That property wasn’t his primary residence though.
I dunno. I’m tired of the world pretending that “words are just words” and what is said doesn’t matter but physical attacks somehow do. You can cause damaging emotional harm to another with words. When will we start to “get” that?
Look at all the teen and child suicides over “words” and teasing. People discount mental health. They want to see bruises and bleeding and broken people, but sometimes people are broken by others in places we can’t see. It doesn’t mean it’s not as damaging.
Perhaps the world would be a better place if people were actually held accountable for their threats? And if you throw around public threats to the point that a person finally responds that it’s the equivalent of taunting and throwing the first punch? I’d be fine with that. Also, the police should have responded. Why they didn’t I have no idea. Did they discount him assuming he has mental health issues? I will never understand their refusal to help. Horrific. Did they write him off as a delusional person? I’m so curious.
Anyway, having family members with significant mental health issues has shaped and changed my thinking. Words matter. Threats (verbal or otherwise) should matter, too. Imagine how the situation would be different if there was some accountability for all those 19,000 pages of nasty posts. With boundaries and accountability LK may have actually been a better citizen of the world and she might even be in this forum with all of us talking about horses instead of this tragedy. We will sadly never know.

Yes, and she also posted that she went back to train with him a second time. He must not have been that cruel, huh? The information I received about the horse going to FL was it was a simple miscommunication between the woman and Barisone.
