Except when it doesn’t. They went over the false in one; false in all concept. So much of their testimony wasn’t simply ‘imperfect’ it was false. So that evidence (“evidence”) can under the law be completely discounted.

Now what are you left with?

Having a gun or even bringing a gun somewhere in no way proves that you shot it should it at some point be shot. The stats on people killed with their own guns (not self-inflicted) tell you this along with common sense.

Again, this is why PD’s do forensic testing. In this case, they did not.

I don’t think they found any illegal recorders when they did their $5000 search. I think they think they were there because private conversations made their way back to LK but I suspect that was normal barn gossip spreading fast.

Thanks for clearing that up. I wish I could stay glued to the trial like some people, but I’ve got things to do that can’t be put off. Woe is me.

Simring testified that they DID actually find multiple recorders.

Which made MB that much more paranoid.

It was part of MB unraveling in the final week. He started interpreting everything in a way that reinforced his state of mind regarding LK being a larger than life threat who was persecuting him, and was going to annihilate him.

If a woman says she is raped, does there have to be a video or a semen sample collected from her that matches the accused’s DNA?
Or is her testimony sufficient?
Do you think there is semen and a DNA match with Rich Fellers? If not, is he automatically not guilty?

I knew someone like this once. I believe her issues were kicked off postpartum. It was scary–like invasion of the body snatchers scary. She did the same thing–misinterpreted every bit of information and ran it through a very dark script. She wasn’t sick enough for a hospital, but it really messed up her life. She even ran afoul of the law (no charges, but almost). This was a highly intelligent, educated woman. There one minute and gone the next… Mental illness is so sad and frightening.

I don’t know. The instructions have to be pure, yes. However, a defense of my client didn’t do it but if they did then they were insane and attacked is kind of nonsensical. Once that is entered, it’s a statement.

Add to that all three mental health doctors stating he shot them and one, Dr Simring testifying that MB told him that he got the gun out of the safe and didn’t remember anything after that (a difference from what he said to everyone else, that his memory stopped at the now I forgot the acronym. DPPC?) then the it’s kind of a moot point.

Did you sign a contract with them? Because a third party usually can’t pull a permit for a property owner without written permission.

Yes, it is common for contractors to pull permits but it is usually part of the agreement. The owner has to sign something.

I haven’t seen any of this, so I have a question - why don’t you think the jury is considering the charge that is something like aggravated assault due to diminished capacity (exact wording is way off here)? I only watched the first few days of the trial and I don’t see how attempted murder was proved, but I also don’t think MB was shown to be legally insane.

No matter what the jury does with the shooting charges, I really don’t see how they can find him not guilty of the gun charges. I really hope the outcome results in MB getting a lot of mental health care because it’s clear he is not a bad person, but it’s also clear that he is in a really bad place mentally and spending the last two and a half years in jail has seemingly exacerbated his issues.

I really don’t think a not guilty verdict will do him any favors because he clearly has no one in his life who understands how to deal with and help someone with severe mental health issues, but I also think a guilty verdict that results in significant prison time will be a real shame and will completely break him, which he doesn’t deserve. This is a really tough case for sure because there has to be consequences for shooting someone, no matter how vile that person is. That so many people here can’t see that part is horrifying to me.

No, I don’t believe it is. The 911 tapes are just evidence of what was said on the 911 calls. They are not evidence that what was said was true. There are loads of cases of false 911 calls, so just b/c it’s on a 911 call does not mean it’s evidence.

FWIW, this was the one fact that jumped out at me from the very beginning that piqued my interest. I found it so unusual that someone would say [first name][last name] shot me. It sounded false to my ear and maybe like a set up. This was before I knew anything at all, LK had not come on the threads, didn’t know who MB was, etc. It just stuck out like a sore thumb for me.
