The judge was very clear, that impeachment was something for the jury to decide. Several things were used by the defense for impeachment, and each thing admitted had LK and RG reversing the testimony they had just given. The weight of those considerations rests solely with the jury at the time of their deliberations…

It is the DUTY of the jury to “unhear” what the judge has barred. The jury can only consider the testimony and evidence that has been successfully submitted and accepted.
No one has testified that Barisone did not get the gun, load it and bring the gun to the house. No one has testified as to any alternate scenario than what LK, RG and ED described. Two shell casings were found. LK had two gunshot wounds.
The absence of evidence - DNA, GSR, video - does not matter. The jurors cannot speculate on what ifs, they can only weigh the testimony and evidence presented. RG and LK were not impeached, no evidence was presented contradicting their testimony.
The testimony of the three psychologist s are offsetting opinions.
The testimony of Dutton and Martin is more of a character defense: He was a nice guy, a good rider and I never saw him hurt anyone. Plus, jurors aren’t going to swoon over Olympic riders, they are just other rich guys who ride horses.
Barisone was in an awful situation, he was mentally ill (but not indane) He was enraged, he made a terrible decision to get a gun and use it.

First, no matter what you say or think, the jury will not unhear testimony. They can choose to ignore it, but they can’t unhear. Second, what qualifies you to say he wasn’t insane? Third, 50% or more preponderance of evidence. Fourth, you not I have any idea who the jurors are going to “swoon” over…maybe there will be the lone juror who does and results in a hung jury

I understand that the judge ruled today that enough evidence was given that the jury can consider the claim of not guilty by insanity. But there was not enough evidence for them to consider the claim of self defense. Thus while we may all have our own opinions the jury is being instructed to consider that. So we cant say definitively until the jury speaks and we will never know the truth as experienced by MB.

One of the interesting things about being Bob is that none of his interlocutors feel. Bound to mince words about LK because hey, Bob is just some random troll dude. I wonder how Bob feels about the entirely negative view of LK on the livestresm?

The thing that strikes me, the reason given the most for us lay watchers for saying not guilty, seems to be the perception that LK/RG were lying on the stand.

But what solid evidence is there to support that the events the two, known liars laid out is true?

None, as far as I can tell.

No fingerprints, no DNA, no gunshot residue. No video from the missing camera. No third shell casing, or any bullets whatsoever. No search of the other two vehicles and trailer owned by RG at the scene. All courtesy of the local police department.

The testimony of the ear witness was not consistent with the testimony of the two eyewitnesses, whose testimony was not consistent with each other. Even after they had 2 1/2 years to work on it.

There is no physical evidence to prove the LK/RG version is more likely than the version involving a struggle with the gun.

To me, if you have two equally plausible versions, separated only by the word of two people who demonstrated under oath on the witness stand that they are drug users and liars, along with their stated intention to “ruin the life” of the other person, that’s reasonable doubt.

Dang, this should be the defense’s exact closing argument, word for word!

I would not expect a victim of violence to be on chat insulting every one especially if their own character was at stake in the trial. People whose past lives are questionable usually try to put on a very respectable face for SM appearances. They don’t keep demonstrating that questionable behavior.
