To further clarify analyst response from yesterday, he asks why didnt defendent shoot RG before he got on top of him. They must not realize it was supposed to be out of ammo then.

It happens on COTH all the time.

You mentioned the idea of locking everyone in as a safety option.
I recalled someone suggesting there had been threats of fire at SGF where you’ve never been, correct?
So your idea of locking animals in, applied to the circumstances we’re actually discussing, which are not about you, and my recollection of the fire threat is what my post was about.

Yes, but then that begs the question we’ve all been asking….if MB was in his right mind and went there with the purpose to kill them…why didn’t he have a full magazine?

maybe he didn’t have enough ammo, or didn’t have time? Could be a million reasons, let’s see what the trial brings about that.

If there was a second, full clip on MBs person, as has been suggested. … As someone who doesn’t regularly target shoot*, or use a handgun*… I’d think putting the full clip in the gun would have been part of the plan, that these murderous plotters had hatched were this a premeditated plan to go shoot them.
It seems obvious to me that a murder, plotted over such a long time with several participants, would have hinged on ample ammunition considering the shooters lack of practice*. shrug

*I’m not aware that MB was a shooting range regular or known to target practicing.

@RND, what hasn’t been mentioned (I may have missed it) is that Mr. Bilinkas has a duty to advocate for his client. Saying “it is consistent with self defense” does that. It paints a picture in favor of his client. And, it is true. Now, you say it’s not completely true. Mr. Bilinkas has no duty to say, “but it’s also consistent with attempted murder” and that might even set things up for an ineffectiveness of counsel argument. (I don’t know if it would rise to that level, but it would be a completely wrong move on his part.) The prosecution can bring that up if they like.

Lastly, in law school, we had a mock jury trial. We had cameras in the jury room so we could hear the deliberations. Never underestimate the wild things folks will base the decision on…including hair color. We were completely flabbergasted by things made up out of whole cloth…

Correct, many possibilities. According to the defense he doesn’t have any memory of the time from the visit to safe sport and through the shooting. It appears he went to the safe and took out the gun and then went to where the victims were staying. If he was insane at the time and no sense of what was real I can see him just grabbing the gun and not checking to see how many bullets were in it, or also if he was in a fit of rage and not insane. Good thing he only had 3 or he might be on trial for murder.

Did they confirm they were the correct type for the gun used?

I’ve yet to hear of a second magazine. Honestly, the officers are kind of glossing things over. The prior reports on the testimony said MB was searched a second time and it was found in his pocket. So far no one has admitted to a second search of MB yet. Heck, with I think 4 officers on scene, we still have RG running around chasing a dog….and no one paying attention to him…
