If three people are present in a shooting, two of them are in an antagonistic state with the third, and the third is the shooter who discharged multiple rounds regardless of whomever of the two other individuals they intended to shoot with each round, multiple charges will be filed. Also, they want more charges as leverage in plea agreement negotiations.

Nope, I don’t know LK do I? EB knows MB. I’m supporting a victim of a violent crime. Not someone who tried to kill someone. Not a hard concept to grasp.

Sorry, hit post too soon. Here’s more from the defense’s opening statement:

LK and her father enter into training agreement with MB. MB agrees to provide LK living accommodations.

LK’s social media posts will tell the real, scary story. LK becomes obsessed with MHG, starts attacking her. Accuses MB of abusing horses, not paying bills, committing insurance fraud, etc.

Because of those attacks MB starts inquiring about LK and RG from other horse people. MB becomes afraid of LK. (Lots of emphasis on social media posts here.) MB starts seeing LK’s posts about guns, war, etc. MB contacts LK’s father and tells him she has to leave. LK “threatened to kill both her and MHG” (not sure who “her” is). MB flees house and is now sleeping in the barn clubhouse. MB hires private security company on 7/31.

MB calls 911 and says he’s in fear for his life. Police say it’s a civil matter. MB calls USEF general counsel, CEO, police again, etc. On 8/1, LK comes to barn after hours and is told to leave by owner of property. She refuses and MB calls 911 again.

Washington Twp and Morris Co prosecutor talk about the case and tell MB he can’t restrict LK’s movement around the farm. MB pays private security guard to sit in a truck outside the barn. MB starts walking the property at all hours of the night. MB and MHG send MHG’s son away to father because they’re concerned for his safety. MB (I think? My phone rang) finds suboxone packages in LK’s trash.

Had to pause for a phone call so now I’m behind…nice of this to start during lunch though!

We couldn’t see much of him in the pre-trial, since they did that via Zoom - but he’s been incarcerated for almost 2 years. That can be mentally tough. He’s likely used to a very specific schedule and people around him. Something as unknown as a trial may be very unsettling for him. Very well may be regretting not taking the plea bargain right about now.

There’s a reason that re-integrating detainees back into society can be very hard.

Do you think the police not doing anything argument helps or hinders the defenses case? Might it make the jury think its bogus claims since LE didn’t do anything even though they were called so many times?

Actually, it is. Not all victims of violent crime deserve my support, and not everyone who tries to kill someone deserves my lack of support. It’s not always conveniently black and white.

How does MB’s lawyer know all these details of the shooting if MB can’t remember anything?

That’s what they are going for. This is general statement before ppl attack me, but that’s a common tactic in trials.

I replied to a statement you made. That is not a hard concept to grasp for most people.

If you don’t want other people reading and responding to your statements, take it to private messages.

The Judge seems to have his microphone on and a bit too close to the top of the desk, where his paperwork and such is. The noise is really stifling the audio of the presentation.

More from the defense opening:

LK and RG reported MB for unpermitted renovations and unsafe housing. RG was the one doing the work. MB is kicked out of barn by inspectors and is now sleeping on mattress on stable porch. RG was there pointing out everything to make sure MB got kicked out. Behind their backs RG made a gun shooting gesture with his finger and mouthed “Get ready.”

LK makes another threatening post about having eyes/ears everywhere. Farrier doesn’t want to shoe LK’s horses anymore because of what’s going on so LK, RG, and farrier argue. RG says, “There will be consequences.”

Coup de grace is LK’s false accusation of sexual abuse by MB of MHG’s son. CPS shows up the day of the shooting. MB becomes aware of the allegations. He starts having a mental breakdown and has no memory of what happened after that.

Evidence will show MB got into truck and drove to farmhouse. According to RG, MB says, “Can’t we work this out? I don’t want to go to war.” RG says, “We’re past that. Talk to your attorney.” RG turns around and walks away, and LK passes him to confront MB. Evidence will show MB was severely beaten by both RG and LK, which they did not mention in original statements. He was also bitten by their “vicious dog.”

When police arrive RG and MB are rolling around on the ground. Gun is not in anyone’s hand. RG keeps saying, “Don’t move, I’m going to fucking kill you.” (Sounds like this might be in the background of a 911 call?) First officer asks who the shooter is and RG says it’s MB.

MB was beaten so severely he couldn’t answer. Officers describe him as partially conscious, incoherent, etc. MB says, “Is this real? I need to wake up.” Tells everyone he doesn’t remember the event.

RG allowed to walk around. There was a camera right above where this occurred. Police/prosecutors were aware of it that night. RG says it would have captured the whole thing. Camera was not seized that night. Months later when police/prosecutors tried to download the camera, nothing was on it.

Psychologists/psychiatrists will testify he was suffering from a mental defect, felt his life was threatened, did not know right from wrong.

ETA: I missed a little between my last recap post and this one. Based on @Knights_Mom’s post below, I think what I missed was mostly about the listening devices.
