Barisone Verdict Is In: Not Guilty By Reason of Insanity

Reminder of this last post by IM on April 14 after the verdict. Reading it today is striking in what he(?) actually says.

This is a great verdict for the Kanarek family. I’ve long made clear the family has no hatred toward MB.

It has been you who has been having a 2.5 year fantasy…constantly telling the good people on COTH what really happened…in your distorted mind.

Do you not understand what happened? The charge to the jury was clear. To find the defendant not guilty by reason of insanity the jury must believe that THE STATE HAS PROVED IT’S CASE BEYOND A REASONABLE DOUBT…but the defendant is not criminally responsible because he was suffering from a “mental defect.”

Most people in prison are there because they were in a dispute with someone or hated someone or feared someone. There are a bunch of “liberals in name only” on this page who would be repulsed by gun violence but are ok with gun violence if they don’t like the victim. What a bunch of hypocrites!

Your nonsensical fantasy that poor MB was attacked and defended himself can go on the junk pile with the rest of your crap. Everyone knows what he did.

Do you think the Kanarek family cares if MB goes to a state prison or a state mental hospital? Congratulations to those who think this is a cause to drink champagne. I can promise you it is the Kanarek family drinking champagne.

Bilinkas was very careful to say private conversations were recorded but he would never say “recorded illegally”…he knew better.

If he believed JK was the mastermind he could have called him to the stand…he was afraid to. If he brought up the recordings to JK, JK’s response woulda been…“do you wanna discuss what’s on the recordings?” What’s on the recordings and who is really responsible for ruining MB and LK’s lives is of far more interest to 48 hours than your constant whining that she sent you a nasty PM.

Having Bilinkas call experts to show that MB has long suffered from mental illness was a great Jedi mind trick by the Kanarek family.

The key defendant in the civil case is Hawthorne Hill…they have lots of insurance. They should have known about MB’s long history of mental illness and suicidal tendencies and had an affirmative duty to keep guns off the property. Thanks, Bilinkas for your help.

And, btw, remember Bilinkas tried kept saying the Kanarek family has filed a civil suit against Barisone? That’s true. You know who else has filed a civil suit against Barisone? Hawthorne Hill!! Are you offended by that lawsuit too?

Steve Tarshis is Michael’s longtime friend and attorney. He testified that he had several conversations with JK offering to move LK to a wonderful top trainer nearby.
If he believed for one second that LK was this horrible, dangerous person, who was so dangerous people had to sleep in the stalls to protect their horses…why oh why would he go out of his way to bring this nightmarish woman to a new great trainer???
Is it not 100% clear that Steve Tarshis did not believe one word of the crap that MB and MHG were telling him (and Egg On Your Face was stupid enough to believe) and that he was convinced it was his friend and client MB who was a nut case?!?!

We’re in the next county over from Morris and DH used to work at a local hospital. I was amazed at how many mental patients who were taken to the ER had to stay for days (sometimes weeks) because there was no open bed at an in patient facility. It was so amazingly sad.

Sidebar - he did once have a young girl who just broke his heart. She liked horses and he is always up to talk about his horse and show pictures, so he was able to help her stay a tiny bit better.

I don’t know the official rules so I might be wrong, but from what I understand the answer is no.

As a personal visitor that meets all the jail’s criteria for visits, sure. But they would still be subject to jail rules which includes possibly being recorded, etc. and they would be going to support MB, not in any kind of official capacity. For example, his 20+ year therapist could go see him as a friend, but they wouldn’t be afforded any privacy or anything.

He was with the therapist for at least 37 hrs already in jail. Usually prisoners can have access to mental health professionals in jail, whenever they need it.

In theory, yes. In practice, it’s not that simple. Usually there’s one contracted mental health provider. You put in your request to the CO to see them. CO forwards it up the chain of command, where it crosses desks until it gets to the medical staff and placed on a list. Meanwhile, anyone in active, visible crises bumps everyone down the list. Then, say something happens that the facility goes on lockdown. Requests are put on hold until lockdown is resolved. And other delays happen.

You can bust a tooth on the stuff they call food and wait 30-45 days to see a dentist or more, where they tell you you have to have xx dollars on your books to cover them pulling it, and if you don’t, back to the end of the line you go.

Edit to add: the time he spent with Dr Simring, Dr Hasson, and the Stache were a) to aid in his defense, and b) to rebut that. His defense is over. He’s been acquitted. His rights to move to a state run treatment center aren’t as imperative in a legal sense as his right pre-verdict to defend himself.

If there is no bed available I hope the State would be open to other options.

I would think they have no choice. They can not just hold him in jail until a bed happens to open at this one facility. That is crazy for so many reasons. But in the big picture the most important reason is that he needs to get some mental health support and that is not happening in jail.

This is a worse situation than I predicted.

I do think they will be stuck working through Ann Klein for the defined 30 day evaluation period. One of the knowledgeable mental or legal professionals following this discussion can weigh in… but it is a much more secure facility than a more general inpatient psychiatric facility (though a more general inpatient psychiatric facility is also almost always secure).

However… after he completes his initial evaluation period… if there is a way to move him to a more general inpatient facility… and the doctors have recommended that he is no longer a high risk, comparable to other patients in the forensic high risk facility for legal reasons…

they will move him on from Ann Klein.

There is a nationwide crisis with a lack mental health care providers at every level. But most especially, when it comes to any kind of inpatient mental health care in a secure facility. I’ve had family members who required inpatient care on 3 separate occasions within the last 15 years. All involved very high suicide risk (one had made an incredibly violent attempt that involved beating another family member in the process)… and even so… the second anyone was minimally stabilized… they were released to do outpatient treatment. Because the need for inpatient care in secure facilities for people who are at risk of self harm, or harming another person is so incredibly high.

There are nowhere close to enough inpatient beds. For anyone. Anywhere. Not even at private hospitals. Private hospitals are all picking up the overflow of people in crisis, for whom there are no beds at a public facility. There are high end private sobriety focused clinics, that also offer mental health therapy of one type or another. And those are places where people who can pay several thousand out of pocket can stay “inpatient” for extended mental care. But everywhere else? Extensive mental health care and therapy really happens in an outpatient setting. Inpatient care is about safety (in terms of self harm, or harming another), and immediate stabilization of psychotic conditions, and probably other serious conditions I just don’t know much about.

Seems to me to be poor planning on the part of the court given this was one of only a few possibilities.

I think the reality in the short term, when it comes to mental health care for MB, follows key objectives:

1. Is the psychotic condition identified as a factor in the shooting back in 08 of 2019 stabilized?

2. What safety concerns still exist? Is he a danger to himself and others?

3. His diagnosis of depression and anxiety. How is he at present? How does he score any number of depression assessments that are widely used? Is medication in the immediate term advisable?

I would imagine these are the first areas that need to be addressed with respect to his mental health care. And after these key things are evaluated… then a treatment plan can be developed, and commenced.

Soooo… unfortunately… these things take time. As much as MB has suffered, and is ill… there are likely lots of people in the mental health system in the state of NJ who are completely reliant upon the state for care (meaning they are homeless, impoverished, and have no identified support of any kind), who are in the midst of completely horrific psychotic crisis. Sadly… this is the case at any given time, in many areas of the country.

So, as much as it is awful that he is waiting in jail… some of the situation might be a result of triage in the mental health care system. Just… a really sad reality.

Pray for patience and stability. He’ll get there. It’s just the way things are in the US system right now.
