I thought the inspector knew that MB was the owner. I wonder if a fake email account was set up or they spoofed one of the phones so it appeared as though MB sent the photos.

As an inspector he could well have been liable if the house had burned down, which would have been worse than ending up on the witness stand, explaining that he took JK’s word that the house was now safe…

JK’s word? Wow, I thought it was LK that had texted him. I missed that bit of testimony, though, so am basing my comments on what others have said.

Also - wasn’t it sometime in the late evening when he was notified? And basically “off-duty”?

A lot of people thought it made him seem disorganized, but one thing he did so well was keeping RG and LK off guard by jumping from topic to topic. As soon as they started getting comfortable he’d hit them with a question that was completely unrelated to the last several and their brains could not switch gears fast enough to answer. So you’d get confused looks, requests to repeat the question, and a lot of rambling. They couldn’t stick to a script because he didn’t have one.

I just don’t see anyone who is being honest saying, “Yeah, I know there’s no GSR, fingerprint, or DNA evidence to indicate who was holding the gun when it was discharged and, sure, the two people upon whom the story rests were shown to lie literally while on the stand under oath, and of the stories told by the 3 people purporting to tell me the story/timeline of events all differ in major/substantive ways (not small details),…

And I again post this photo of Schellhorn watching another of his star witnesses twisting in the wind on the stand. You just know he is thinking, “Hmmm. That is not what that guy said before about the events that day. So is he lying now, or was he lying then?”

Yep, I think it was really dawning on him that his case might be falling apart. But he couldn’t end the case by other than asking for a mistrial - correct? And I doubt he wants to go through this again.

It just sounded odd to me that she would need someone to groom in addition to the full training service she was paying (or supposed to be paying) for as a boarder at MB’s barn, or any full service barn, for that matter.

Or perhaps they agreed to do their own grooming (currying, brushing, etc.) in exchange for the discounted rate they were getting?

I generally tend to think of full board and training being the type of arrangement where the client could basically just get out of the limo, get on the horse, ride, and then leave if they wanted to. But obviously, there are infinite variations at different operations.

To me, that would be a horrible way to…exist in the horse world.

Yep, I think it was really dawning on him that his case might be falling apart. But he couldn’t end the case by other than asking for a mistrial - correct? And I doubt he wants to go through this again.

There was one point where Mr B crossed a line, asked a question and I can’t remember which witness answered it before anyone could object. On there way to sidebar, you could hear Judge T very angrily saying “we had a hearing about this” before they cut the Mike. I thought Mr Schellhorn was going to ask for a mistrial then. But they came back, the judge instructed the jury to disregard and everyone moved on. I think at that point Mr Schellhorn just wanted it over and not to have to hear versions 7-12 or more from his victims.

So, proper process, they should have looked all that up when they got the complaint so they would know who to notify (and fine). You can bet LK and RG weren’t going to be screaming it was their property if that $5,000/per day fine for staying in the structure had kicked in.

I think that happened during RG’s testimony but I can’t remember the question.

And yes, I think you are right - Schellhorn didn’t want to hear versions 7-12 from his star witnesses, and certainly didn’t want the jury to hear them!

I am also guessing that he was starting to think about what a huge time-suck that trial had been. And how close Mr. B was to making a fool out of him (Schellhorn) for pressing the case.

I honestly think the verdict should have been a straight Not Guilty on all charges. MB should have already been released. His loved ones could have already gotten him the psychological support he will need to make a full recovery.

But, he sits in jail. What a travesty.

I honestly feel this way, too. None of the pro-LK folks was brave enough to give me a straight yes/no answer to my question: would you be comfortable having a close loved one convicted on this evidence? I just don’t see anyone who is being honest saying, “Yeah, I know there’s no GSR, fingerprint, or DNA evidence to indicate who was holding the gun when it was discharged and, sure, the two people upon whom the story rests were shown to lie literally while on the stand under oath, and of the stories told by the 3 people purporting to tell me the story/timeline of events all differ in major/substantive ways (not small details), but nonetheless, I think it’s correct that my [father/brother/husband/son] goes to/stays in jail for this.”

I call industrial strength and the blatant evasion of merely answering that question as asked with a yes or no told me all I needed to know. Once you take the emotion of disliking MB/liking LK out of the equation and apply this complete lack of evidence to the situation, I do not see how a reasonable person could convict. I don’t think they ever should have gotten to the insanity stage b/c they simply didn’t show me the most basic information I needed: who was holding that gun when it was shot.

I don’t even need to think of all the various scenarios that could have happened. They fundamentally failed to prove to me that MB shot that weapon, let alone when and for what reason. They could have even shown me that LK/RG likely did not shoot the weapon. All they needed to do was swab everyone for GSR. But, nope, they didn’t even give me that!

But, it is what it is now and the State has a duty to him to get his care and evaluation sorted, get him into the least restrictive environment, and get him out and on with his new life which I hope is eventually even better than before.

Thanks for the info. I am trying to watch bits of testimony that I missed but dang, it is hard to figure out which You Tube video to view. They are listed by Day in the title, but I wish they were timestamped so I could figure out the sequence.

Put that in the long list of things that made no sense. The sloppiness of how that town is run is beyond me. I hope the citizens there are demanding answers from their city manager and police chief.
