I would imagine that he would file a counter suit to hers with a long list of damages including loss of business and can guarantee it will be in the tens of millions.
ETA - plus libel and slander.

Ok, repeating lies like Alex Jones saying the shooting at Sandy Hook was a hoax and the children never existed and their parents were “crisis actors”. Is that non political enough?

Now, I am not a lawyer and do not play one on TV and have not done that whole Holiday Inn Express thing, but I thought the first part of a personal injury case is that they have to prove who is at fault.
To me, the fact that jury said not guilty by reason of insanity and that the trial said the insanity caused by LK, it would be hard to say that anyone but LK is responsible for their damages.

More likely the criminal case had a level of proof of “beyond a reasonable doubt” while the civil case had the lower “by a preponderance of the evidence.”

Whatever one thinks about Judge T’s alleged biases and his manner of speaking to Mr. B and sometimes sometimes the other counsel, he was very gracious to the jury, and the witnesses excepting of course the paid witnesses. Judging from body language and remarks caught on video, court staff seemed to have a good working relationship with him too.

Lawyers get paid to advocate and argue. They can be really annoying at times. I say this with great affection for the lawyers I work with and respect for the profession.

Re: the civil case, three points:

The Plaintiff in that case received her bronze medal in 2020 and earned scores similar to at the same level of her pre-injury scores. In fact, maybe slightly better. Damages?

As for the Defendant’s counterclaims regarding what was intentionally done to him–he is the model eggshell plaintiff. Under the doctrine of the eggshell plaintiff, the defendant who has aggravated an eggshell plaintiff’s pre-existing condition is liable for all of the consequences of the result. The question is whether or when the doctrine applies to mental health injuries in New Jersey. This kind of thing varies from state to state.

Finally, the Plaintiff was in the hospital for approximately 3 weeks; the Defendant likely will be receiving some form of residential treatment far longer. It is likely that his medical bills will far outpace hers.

I did notice the judge had his arms crossed in front of his body a lot when the jury was going in and out, though. Lol. :woman_shrugging:

It shows as Protected for me - I would need to request access, which I have no interest in doing.

I wonder if rather than completely nuking her FB if she set privacy settings so she does not show up in a search at all. I find it hard to believe that she’d completely shut it down.
