An appeal makes sense but should the selection factors not still come into play?
any one know the appeal procedures and protocol?
surely the appeal does not lay to the same selectors?
is there an administrative body to whom the appeal is directed?
and what are the arguable grounds (selectors, I disagree with your decision is surely not one)
and … what of the person who may get bumped or the selectors themselves… is the decision of the appeal subject to further appeal or judicial review?
so … i have just figured out that the appeal goes to SDRCC (though I had to google that to find out what tribunal it is)
I am fairly sure that an application for judicial review of their decision is possible though likely prohibitively expensive unless you have a ton of wealthy backers.
What a sh!t show. Might be a blessing for whoever doesn’t get to go now – with all the other ridiculousness going on in Rio.
From what I’ve heard, the conditions in Rio are pretty bad. I hope all the publicity the past couple of months in particular will urge the city and country to make some improvements, especially as it relates to the equestrian sports.
I believe years back, when Stuart Black was still a Canadian before he became an American, he made an appeal. I believe that his appeal was denied (chronic health issues???) and the team stood as announced. I can’t remember if it was for an Olympics, Pan Ams or WEGS. Hopefully, my memory isn’t too foggy about this and please correct me if I am wrong.

But I would think that if you can appeal court cases, you could appeal this.
JP is the first time that there has been an appeal.[/QUOTE]

I don’t think your memory is too foggy canuckeventer, I recall that too.
The Eventing Connect story quoted an EC official who said that the arbitrator’s decision was not due for 14 days (from the date of hearing ?). So that sounds like they used an independent arbitrator.

Oops - I meant to say that JP was NOT the first appeal. I don’t know the rate that they are successful though.

I believe given short time frame, they likely bypassed internal appeal process and went straight to arbitration (which is done through SDRCC - the Sport Dispute Resolution Center of Canada). My understanding is this can be done if both parties sign the SDRCC arbitration agreement.
I’m pretty sure that the officials are working feverishly to get things as good as they can be, and at this late stage it is what it is.
The world’s top athletes will be there as well as the horses - I’d go in a minute and expect a great time.
There is always a lot of pessimism it seems: time will tell.
It’s Sport Dispute Resolution Centre of Canada. It must be an initial fact finding body along with making quasi judicial decisions. They have both mediators and arbitrators on their roster–and they are required to publish their decisions.

I wonder if one could appeal from its decision to CAS. I rather think that one could.
I do wish the US had something similar that would keep these things out of the court system.

It was for the Athens Olympics. Even after the appeal, even after Garry was named to the team, he showed up with his horse at the airport when the horses were flying out!
Wow Canada eh, just full of the Olympic equestrian drama. I will say it’s nice for once to have people interested and discussing our team.

OMG I remember hearing / reading about that
hope the poor horse wasn’t actually on the tarmac with all that airport noise
Apparently Australia just had an appeal too and named their team. Looks like we are just the cold version of that place lol.
Posters are pretty frank in their opinions of certain people on this drama, but the selection committee has not been mentioned, or are they a secret, too?
I believe they were mentioned, the coach is a selector for one.
Ozzie, Clayton Fredericks and a rider whose name I have forgotten have been mentioned.

I think that’s proof that Mr. Black isn’t a ‘real’ Canadian.
