I think the “missing gun” bit came about because RC was worried about her gun being taken by MB. I think she started worrying about it when she heard about MB curling up in the fetal position (testimony by MHG). I think MHG’s dad came because he was worried about MHG in regards to all parties. MHG read texts in court where she asked MB why they couldn’t just ask LK to leave because no one has. She also testified in court comments were said to LK that if LK was so unhappy why didn’t she leave. There is a difference between being advised to leave if you are miserable in a barn and being asked or told to leave.

What is it about the transcript being compared to the audio that has you so freaked out?

If it all supports their story, if it contains a bombshell, then you should want it all exposed and reviewed…

If, for example, no recordings have been disclosed that say anything close to that, and neither MB nor SGF have any evidence that recording exists, the transcripts become the last known piece of evidence which could lead to further questions and discovery re: said recordings.

SS’s report relied on the transcript provided by KK - correct? And it would not be surprising to learn that transcript reported only (or mostly) the conversations that put MB/MHG in a bad light, but left out or glossed over the questionable conversations/behaviors of LK/RG.

Is that simple enough for you?

Putting the K’s aside, if you were being sued by someone for say millions of dollars, are you going to trust what one of the parties produced themselves? Or something an impartial, swear under oath, professional has produced?

If any of the statements quoted in the SS report do not appear on the original recordings, such as “I’m going to effing kill her” that would be a clue that not all the recordings were turned over, or that the statement was not made. Still no role for any transcripts.

So, you don’t see how a transcript of a recording that hasn’t been disclosed could lead to further discovery?

I think the recordings were mainly in person recordings of repeated conversations. I’m repeating myself here. I doubt RG and LK could place and then remove recording devices in the office environment without someone noticing. I think MHG confided in RC who confided in other people at the barn and at least one was talking to LK and/or RG. Placing them in lockers and under the bench in the aisle looks possible from the photos. Also, RG recording conversations From his person sounds possible to very likely since he recorded the meeting.

NO! You are still missing the point. If KK’s transcripts were used by SS to draft its report, thren those are the ones that are needed to verify if they were an accurate rendition of the actual recordings.

Given that there has been such consternation over those transcripts, I am becoming more and more convinced THEY WERE NOT ACCURATE - which is more proof that LK tried to weaponize SS against MB.

Does anyone know the show schedule for the barn, for that summer?
If I recall LK was entered, but then even though her horses were there, she never showed up. If she wasn’t there, I’m guessing neither was RG.

I’ve worked in a big, top level Dressage show barn.
When we are off to a show, a skeleton crew is left behind with the few horses not showing.
The farm is a wasteland the days of a show.

They may have a copy of the report, but not the ancillary documents that support it. I would want to see the supporting documents, to determine if SS interpreted things correctly and/or if there was anything else in the documents (transcripts) that had been otherwise missed.

Hasn’t Deininger pretty much hinted that the transcripts don’t match the available recordings…….I mean, that was my take away from the exhibits……otherwise, why would he request them.

Then you’re agreeing with my point that the reason Deininger is trying to amend the Barisone complaint is to bolster the basis for Deininger’s subpoena for the transcripts.

I’m guessing that Nagel will object to Deininger being allowed to amend his filing two years after the deadline.

SGF may also object to Barisone trying to say he’s not the one who created the LK tenancy.

The objections to the proposed amended filing should be interesting.
