NO! You are still missing the point. If KK’s transcripts were used by SS to draft its report, thren those are the ones that are needed to verify if they were an accurate rendition of the actual recordings.

Take SS out of it and remember that Lauren Kanarek has boasted all over the internet of many places she has sent those transcripts.
There is no reason for the transcripts to now be hidden by the Kanarek family and the defense has every right to compare the transcripts to the recordings or just read them or to use them as wallpaper.
If the Kanarek family did not make the transcripts into a huge thing they likely would not be being asked for them.
They (Kanarek family) are the people who turned the transcirpts into part of this situation, so part of the civil suit, so it makes no sense that they are now acting like they are impossible to hand over or that they should not be handing them over. They can not have it both ways - hey world, we have the transcripts and we are sending them to everyone all over the place but we do not think they matter enough for the case.

In court proceedings this is done all the time. There is NO nefarious reason for doing this. It is Legal. It is ok. Nothing to get you knicker is a knot about.

And the 2.5 years is because the case was put on hold during the criminal trial. Maybe some people forgot about that whole criminal trial in the middle part.

There was a neighbor who came from across the street (I think) who was talking to 911.

MHG’s father was walking to the house up the driveway from the barn. I think he went back to the barn when he saw the cops were there.

There was some kind of anticipation—at least by MHG—of something going badly. IIRC, she was the one who asked RC to come a week early and had her dad come up, too.

When did MHG’s father arrive? Was he staying at the farm, or had he driven in that morning?

I was always curious about what prompted MB to go to the house. From testimony, he had not been notified that the FM had given LK permission for her and RG to return to the house, so he didn’t know they were there unless he had been tipped off. Did MHG’s father arrive that morning and see RG’s truck there? Or was it the CPS investigator who told MB that there was a truck at the house? Or had LK posted something on FB or sent MB a text to gloat that they had been given permission to return?

One theory is MB opened up the safe, saw the gun missing and went to the house, possibly to retrieve it.

I would this to be more likely than him driving to the house with the gun.

Remember how LK taunted RC about a missing gun days before the shooting???

At this point though, hadn’t they (MHG MB) seen the report from the PI, which I assume included what we’ve seen of Rags record?

They hired the PI on July 31st and received his report either that day or the next.

I don’t recall the timeline, but do recall it was just a preliminary report. I imagine it contained a lot of the information that @LexInVA has supplied here. That would have me wanting them the heck off my property. Last month!

Maybe the CPS worker was telling them the nature of the complaint and guns were mentioned in the report. This alerted MB who then asked them to step out so he could check the safe for the gun. When he did he discovered it missing so he scurried to the house to search for it in order to secure it.

Just a hypothesis.

Then you’re agreeing with my point that the reason Deininger is trying to amend the Barisone complaint is to bolster the basis for Deininger’s subpoena for the transcripts.

this isn’t how the law works. The subpoena request was already issued. It’s being decided before it’s been decided if he can amend the complaint.

The amended complaint will have nothing to do with the decision on the subpoena. If the transcripts are more likely to be relevant than not, the discovery rights allow for them to be demanded. That is what is being decided today.

If the amendment is permitted, then it allows them to collect further discovery, probably at deposition, as to exactly how those recordings came to be, but it has nothing to do with the decisions that are supposed to come down today on the subpoenas and depositions.

Either what was reported to SS by LK is consistent with what is on the original audio files or it isn’t.

And if the audio doesn’t match the transcript produced by KK, then she (and her associates) tried to manipulate that audio to effect SS
