It just occurred to me that if LK/RG recorded the phone conversation between MB and Tarshis that occurred in MB’s office, they also had a recording of MHG’s conversation with the CPS investigator (a conversation that also occurred in MB’s office). That to me smells like an extremely egregious violation of MHG’s and the child’s rights to privacy and should warrant further investigation and possible criminal charges.
I’m not sure absence of gsr on her clothes suggests this couldn’t have happened.
It simply means it wasn’t as close range as some assume this would be.
Also wasn’t her shirt cut off and on the ground in the pouring rain? How does that effect gsr, especially if bagging the item is an afterthought as it appears doing forensics is to this PD?
Two things can be true. You can be evil and lazy. You can be unfocused and sloppy on drugs, or manic, paranoid and hyper-focused on drugs. Addiction is complex, maybe they had periods of sobriety where they functioned better and periods of time where they did not function at all.
I think RG did crappy work on the house not because he was so unskilled, but because he didn’t want to do it. He didn’t care, maybe he did not agree to the barter agreement that made him LK’s workhorse - who knows. Or maybe LK talked up his abilities so that the work was beyond his scope and he got in over his head and quit trying.
GSR tests results are considered reliable, and should be admitted into evidence. While that is certainly true, given the complete disinterest from the authorities in filing criminal charges for any other LK/RG transgressions, I would be surprised if they made an exception for this matter.
It is also important to note that the absence of GSR does not prove that a person did not fire a gun, since the residual chemicals can be removed by wiping, hand-washing, wind, rain, etc. See State v. Lambert, 341 N.C. 36 (1995)
Maybe that conversation between MHG and the CPS investigator was what LK was soooo engrossed in that she couldn’t bother to answer her phone when ED called.
