MB CIVIL SUIT UPDATE #10 K’s Request to Adjourn (delay) DENIED 11/01/22

“The principle of the thing” is an awfully expensive basis on which to pursue a lawsuit. Especially so when you win, but are unable to collect.

Lawsuits should be a business decision in most cases.

What a great memory! It was obvious in the Buffy episode that he had stage experience. The actress who played Tara had a lovely voice, and the duet of Anya and Xander was really cute. I only discovered Buffy about 6 months ago in these re-runs on Comet and am really enjoying it. (Was always at the barn when it was originally airing).

@Blugal, I agree. I also think that some people don’t realize the impact that this bizarre ordeal could have on a person’s psyche in the long term. The best outcome for Barisone would be to move on and not have to revisit these people at all. I don’t think that any civil verdict will have an impact on Barisone’s future business.

It’s too bad that the Kanarek’s first reaction was to file a lawsuit to see how much they could profit from the situation, but that’s the way some people, especially some attorneys, roll. Yuck.

He needs to be made whole… Including to continue his career.

I hope that in the very least he could get reimbursement for his legal fees although it would be great for him to get lost wages, etc too.

What are the odds he would ever actually see a penny, though? Even if the case goes his way?

That is a good question.

I wonder if in discovery, they can determine what assets the person actually has. Maybe one of the legal peeps can answer this for us.

My point, is that Mr. Barisone is unlikely to just pop back to his life as it was, before this hideous Kanarek mess.

Winning the civil suit would be great, but I think the longer this drags out, the more a detriment it will be to his mental health. Of course he has no control over the K’s greed and he will have to fight with them in court as long as they wish to pursue him. I wish, for his sake, that this legal wrangling could just end.

I’m no expert, but the one I always think of is O.J. Simpson. I think he has barely paid a penny to that family who was awarded more than thirty million dollars in his civil case, and it feels like that was at least 25 years ago by now.

I remember when they announced the verdict for his criminal trial, it was actually piped over the loudspeaker at the Capital Challenge horse show, where I heard it at the wash rack. That was just crazy.

I would bet that his attorneys are well aware of the likelihood, or lack thereof, of actually collecting on a judgement.

So there’s no advantage whatsoever for sabotaging your own suit!!

In fact, it will make things worse, should you not prevail, and have to pay the defendent’s fees! You are in essence, racking up your own demise. The LKs are actually making the possible award of having to pay MB’s fees, which they racked up/jacked up, that much higher for themselves?? Could they possibly be that short sighted? Before we would love to chortle, yes, of course, they aren’t the brightest bulbs in the box, honestly, have they not taken that into consideration? Or are they not planning on paying anything awarded MB at all, and are they “way ahead” of that, and actually removing to another country?

I just cannot, for the life of me, figure out what the advantage is of having an incompetent lawyer, not complying and risking sanctions, leaving the country, fudging around. JK and KK aren’t anything to this case but targets. They’ve established none of their own rights to anything. Please someone tell me what is the point of what they are doing? How does it put them to the advantage, nefarious, dumb or smart?

Perhaps they do have a lawyer, a personal lawyer, who has made it abundantly clear to them that they are on their own, here, put DD’s money in an untouchable account which pays her bills and a weekly stipend, leave her to rot in her own mess, do something, anything, to take the NJ property off the table (I hate to think of those possibilities) and get out of the country. Now that would probably be the smartest thing they could do.

Rereading this, I realize, yes, the NJ property is not in the mix. Unless JK and KK are added to the civil suit. Which could happen if the defense gets the right documentation. They may well realize that they are liable for alot of this mess, should the defense get the right documentation.

In my opinion Michael can not move on and not have to revisit this situation and these people until the world has the ability to truly see what these people do to others for fun. (And, also in my opinion, we have several posters here that prove the point that some people do not see the Kanarek family as intentionally plotting to destroy someone.)

You have to remember that Michael contacted the police department for help from these people tormenting him and that department very quickly sided with the Kanarek group and their ‘innocent victim’ routing.

Until Michael can get it documented in court exactly who and what the Kanarek family did to him, he risks them continuing their campaign to Finish the Bastard and the police once again falling for their innocent victim routine. (Let me remind you again, still just my opinion, we have several posters here that prove the point that some people do not see the Kanarek family as intentionally plotting to destroy someone.)

If you look at long history of arrests for this group (the Kanarek family and Robert Guy Goodwin/Jim E Starks), they clearly have a system for getting away with whatever they do. How is Michael supposed to move on with them still doing that?

The defense at the criminal trial was not able to present the evidence that shows just how this group operates.

I have no doubt that Michael would love to spend his funds differently than paying his two amazing lawyers. I also assume that Michael would prefer to just move on with his life too. But, as we have seen very clearly on this very forum, the Kanarek family is not willing to let that happen.

I will say, thank goodness for the GoFundMe and all the generous people helping Michael with his legal fees.
