She isn’t wrong. She is very careful about her posts unlike those who’s standard responses are “wrong,” “boring,” or “yawn” when you have nothing else to bring to the table. It’s quite amusing.

For example, when you have something you know something about, you bring backup.

You are entitled to your opinion, wrong as it may be. When she says she thinks I’m overly dramatic about threats it means nothing to me as she constantly chastizes many posters for far less. Also I don’t live by other people’s opinions.

The barn was not open to the public. Even if the barn was open to the public, it is not legal to record AUDIO in NJ without the consent of one party, so she could have put a camera up and recorded video if it was posted that video was being taken, but not audio.

I agree what you stated is clearly the law. However, It also reads like a bit of a grey area. It’s private property but the common areas may fit the “environment where they should not be under the expectation of privacy.” I don’t know what New Jersey case law has determined.

I’m in a 2 party state and I do know of one recording where a manager recorded her executive level boss speaking to her in a way that could only be construed as sexual harassment. He was fired and she was not charged or disciplined. If you are a lawyer and this is your field, my apologies. If you are like me, not a lawyer, and just trying to understand the law, then thank you for your knowledgeable post and I am not so sure.

I also suspect what people thought were secret recordings were more likely people confiding in trusted friends who confided in trusted friends and someone was either also a trusted friend of LK or a pot stirrer who couldn’t wait to run tell tales.

I just don’t think LK and RG were capable of laying out and then retrieving illegal recording devices prior to the sweep without being caught or the devices being found. I think it was more likely LK’s mind games plus people talking. There was security, people sleeping outside of stalls, MB paving the perimeter, people on edge in the barn.

There is a reason you see signs about cameras on private property and they do not record audio. Call the mall in NJ and ask what their surveillance set up is, or any grocery store. Those are private property, open to the public, and I guarantee you that they are not recording audio.

Has to be a conversation. She can’t record two other people conversing with each other, unaware of the recording. Just cause she knows she is recording them, doesn’t count. She wasn’t part of the conversation in say, the office, or in front of her locker.

That’s rediculous. The house was already condemed. It was torn apart from the floods. Nobody should have been living in it. It was his house anyway. If he wanted to rip out the electrical, he had every right to. They weren’t supposed to be in it. What a bunch of usery grifters, staying there when MB wanted them out. The nerve.

Security cameras are to deter crime. Audio is for other reasons. Here is another article by a New Jersey law firm.

Is anyone other than me wondering whether the attorneys handling the civil case originally took it contingent? I mean at the beginning of all this they may have thought that was just a layup. And now? Not so much!

By me, to initiate a personal injury case is on contingency. To defend it is not. If then you counterclaim is it a mix? I do not know. If then the plaintiff becomes the defendant on a counterclaim I do not know.

What I do know is that in a perfect life, things don’t become so complicated and twisted.

Life by litigation is neither desirable nor healthy.

@Knights_Mom I for one do not think you are being overly dramatic about Lauren Kanarek’s threats. She has a long history of torturing people just for fun, I do not get why anyone would ignore that history and pretend this time she is not going to act like she has shown she will act.

Now that I know that Jonathan and Kirby Kanarek will have to show up to answer to their Contempt charges, I wish even more that the trial is live streamed.
