MB Civil Trial: JK/KK Contempt of Court?

But… if they were actually sent to SS as part of the evidence that was the basis of the complaint, that caused SS to then call CPS, that caused CPS to send an investigator right out to the farm to investigate child neglect and question MHG?

Well… didn’t Simring testify at trial that the CPS investigator showing up at the farm that day was the straw that broke the camel’s back, and led to MBs full psychotic break?

I seem to recollect that.

So maybe they DID play a roll in the shooting.

But… Maybe KK didn’t make these transcripts that early on, and maybe they weren’t part of a SS complaint. If so… it seems easy enough for her to sit for a deposition and just say so. I wonder why she is avoiding it?

That is from May of this year. Not only after the shooting but after the resolution of the trial.

That’s why I don’t see a legitimate basis for Deininger subpoenaing her over them.

Too bad Kirby didn’t bother to take that up in a motion to quash the subpoena. Now she can explain to the court why she should not be held in contempt.

It’s exactly right that she can point out the transcripts can not have played a role in the shooting if they did not exist at the time to argue why she should not be held in contempt by the judge. That will probably emphasize the harassing nature of Deininger’s subpoena.

Huh? LKs report to SS was made prior to the shooting. How could LK have included them in her SS complaint if KK had not made them prior to the submission of the SS report.

Something tells me none of the attorneys need to explain their strategy or demands to us.

I do think saying Chris Deininger is harassing anyone with his subpoenas or filings is ludicrous. Maybe it’s time for Jonathan and Kirby Kanarek to lawyer up.

Don’t call on my behalf. I think he filed the subpoena mostly to harass KK. He can explain to the judge why her transcripts are needed.

I don’t know how to make this simpler for you, but I’m going to try.

Kirby (and JK with his subpoena, for that matter) don’t get to argue against contempt of court by saying they didn’t see the relevance of the information requested in the subpoena. That’s not an argument against contempt.

If they didn’t like the requests, they could have/should have filed a motion.

Now they get to explain to a judge why they ignored subpoenas, and not likening the request isn’t an option. If that’s their best answers, the court will find them in contempt.

Also, again, Discovery is not Harassment and if you’re offended by the requests, then you file the motions BEFORE you’re in contempt.

No! That’s the whole point of Discovery. Find out what information everybody has and see if it helps or hurts you. If you don’t like what’s being requested, you file a motion to quash the subpoena and make your best case to the judge.

What you don’t do, is ignore a subpoena. That is a good way to get on a judge’s bad side.

It is absolutely ludicrous to think that DISCOVERY in the suit LK filed is somehow harassing her mom because she’s ignoring being asked to provide something she bragged about. That’s so not harassment.

She’ll never produce ALL the records asked for. She’ll use the excuse they were deleted, ruined, lost, etc. So what happens when she can’t/won’t produce all the documentation?
