I’m saying that because Jealoushe has not seen a contract written a certain way, does not mean contracts written x way do not exist. Because Jealoushe does not include a certain clause in their own boarding contract, does not mean certain clauses do not exist in others.

Have you ever seen a contract that states if someone is asked to leave the boarding barn, that they then pay the NEXT months board also?

It speaks to his awareness that they tended not to take directions well and being an astute business professional, such that he recognized they would likely not leave any time soon. And $5k for that number of horses and exclusive use of the house was a bargain the Klan likely wouldn’t abandon.

Any weapon he had on him was long gone by the time the cops woke up to the fact that he might actually be dangerous (he was BTW). Isn’t there a little koi pond near the the house? Did Barney search it? Did daddy and BF retrieve anything out of it the next day? So much we’ll never know as fact had the cops done their jobs, not only the day of but the days before the shooting!!

The first told him to get off MB, held them both at gunpoint, found the handgun, removed the magazine, tilled them to the side, told him to put the dog in the house, kept them in sight while he checked on LK. The second officer arrived, retrieved the first officer’s medical kit, gave it to him, searched MB, handcuffed him, kept RG in sight the entire time, that wasn’t his hearing testimony watched RG put the dog in the house, gone for several minutes per hearing testimony and this was before the 2nd officer arrived just placing her inside the front door that is RG’s, testimony, not Heymer’s. He then handcuffed RG. He found the gun where Heymer tossed it and placed it in the back of Fellini’s car. nope. He testified he found a magazine in Barisone’s pocket.
Heymer said he searched and found nothing on him The third officer found the magazine in MB’s pocket magically appeared after Heymer already searched him. These things happened quickly. They all arrived within just a very few minutes of each other.

You left out Rosie was biting Heymer. Again, proper police procedure would have been to immediately handcuff RG. Then handcuff Barisone. We know Barisone was semi-concious and unable to attack anything after being beaten almost to death. With RG handcuffed, the scene would have been secured. Shoot the dog if it was an issue. Now the 2nd cop arrives. I wonder where that magazine would have been found if procedures had been followed? I wonder what would have been found in the house had RG been prevented from entering it alone for any reason? I wonder what would have been found on RG’s person? These are the questions three experienced cops told me after hearing the testimony. All three said this PD failed everyone, especially their department.

All testifying LE said the call came over the radio as an active shooter.

If MB succeeded in killing LK and RG and arrived back at the main barn with the second magazine loaded with a “hi honey, I’m home, solved the problem” just what kind of scene do you think would have occurred? Just what do you think he would have done if they all recoiled in horror and called 911?

RG saved everyone that day, including MB.

The work RG was doing was water damage repair from the freeze. So long as he wasn’t changing the house footprint, wiring, or plumbing, permits were not required.

The barn never had occupancy for people, the septic tank was undersized, the house basement only had one egress and had occupancy as 2 apartments/duplex-1st and 2nd floor, not 3 apartments basement, 1st, and 2nd floor. The barn did not meet fire code for people occupancy. The house smoke detectors were allegedly ripped out by MB and RG repaired them.

He would likely have seen what was not to code though if he ever worked for a firm updating kitchens and bathroom.

Just pulling out Sheetrock and putting in new tile would not need permits.

Yes. So this says either HH has lived and worked on the farm, or is just making things up because none of us have had the run of the house to verify. A casual visitor to the farm or even a student wouldn’t get inside the house.

30 days notice doesn’t apply when someone is booted out though. If you boot someone out September 15 you don’t get to ask them for October board LOL.

This is not an argument for either side.

It entirely depends on what the BO has written and established in their boarding contract. Not every barn has the same clause. Every barn can be different and there is no black and white, right or wrong situation in business.

If someone leaves on the second of the month, even if “booted,” most commonly they are expected to pay the full month’s board. The facility has already budgeted costs of care for that month for the horse. 99.9 percent of BOs do no buy supplies by the day, they buy it in advance.

Some barn owners and training packages even have penalties for breaking contracts. It entirely depends on the original boarding agreement.

The whole conversation about paying board was initiated on CH’s assumption that August board was even paid by LK. CH is making a baseless assumption in attempts to derail the thread. Whether or not August board was paid for really does not matter. If we are splitting hairs, MB would have been completely justified accepting board since horses did not leave until at least September.

I don’t see a point in going back and forth about board when we don’t even know for fact what money was actually exchanged. We don’t know what work/services were exchanged by RG either.

The horses did not leave until “at least September” because MB interrupted her negotiations to leave by shooting her.

No, it doesn’t. If someone is evicted, their rent check will be cashed until they leave. That is SOP. Cashing said rent check is in no way a reflection of the relationship between landlord and tenant. The tenant owes money for a service, good relation or bad, much like LK owed money for the care of horses. What I would be curious to know is if LK paid MB for September’s care of her horses. Since you feel so comfortable with conclusion drawn based on zero evidence (IE. that LK actually gave MB a check for $5k in August), I’ll make the conclusion that LK did not pay for September. Before you refer back to your favorite line - shot or not, she owed a service. Also, there is no forensic evidence to show MB shot her and also, self defense is a constitutional right.

Testimony from code officials during trial. The basement egress conversation started in the first thread, Woman Shot at Barisone Farm and continued in detail in other threads. Water damage was shown in photographs and we had extensive discussion on earlier threads. I posted permitting requirement links on this thread and more in depth information on earlier threads.

Magazine was found by the 3rd LE officer on the scene. Handgun was pulled from underneath MB by the 1st LE officer on the scene and tossed to the side where the 2nd LE officer on the scene, who handcuffed MB and RG, found it and placed it in the back of Corporal Fellini’s patrol car.
