There aren’t two stories if you listen again to Heymer, Wurtenberg, and Hensley. Day 1 and Day 5.

Heymer checked MB for weapons and threw the cleared handgun away from him. Hensley found the magazine shortly thereafter when he patted him down and put it in the “trunk” of Fellini’s patrol car. Wurtenberg retrieved the handgun from where Heymer had tossed it and placed it in the “back” of Fellini’s next to a magazine.

Heymer and Wurtenberg cuffed MB. Wurtenberg cuffed RG as soon as RG placed Rosie just inside the door as he was agitated at realizing LK was so injured.

Can I please join? I just selected a brand new robe. My old stand-by, red with black Scottie dogs on it just didn’t seem good enough. Although it is elderly like me.

I don’t think so. That would not agree with your stance that the acts must be proven all over again. Of course only proven by a simple majority not beyond a reasonable doubt. Easier burden for Nagel plus full disclosure all parties.

Ok, thank you for your input. Let me know if you want me to explain the elements of a civil suit again, and why the plaintiff having the duty to prove the cause of her injury has nothing to do with “means, motive, and opportunity.”

Also - once again, preponderance of the evidence works both ways.

Thank you for the correction. Is that SOP? I’ve never been involved in a criminal trial so I have no idea. I’m a new elderly illegal mob member so I guess I have some catching up to do with the illegal activities.

She posted on Facebook and other SM how she was in danger, that she overheard a murder plot, but sat tight…

So many opportunities available to her, between those and that 911 call…

Her idea of mitigating a bad situation and mine are very different. :astonished:

It is pretty standard in the criminal trial. An alleged victim never has to sit for an interview with the defense.

The defense can ask for prosecution witness interviews, but the witnesses don’t have to comply.

Going back to the status update on the 4th. Could the judge be giving the parties one more opportunity to comply/agree before the decision comes in and someone gets ripped a new one?

I have only just started using the ignore feature, which I absolutely love. But for me, most of the time, the quoted replies are not visible. The reply shows up with the name of the quoted poster, but then the quote is not shown unless I click on the little arrow to reveal it.

But then once in a while, the quotes do show up. So I’m not sure what’s up with that.
