MB Civil Trial: JK/KK Contempt of Court?

Let me say after having Covid (BA-5 included) 3 times although fully vaccinated, and as recently as three weeks ago, if I had a suit I had initiated as important as this one to my future, wild horses would not keep me from responding to subpoenas, demands for depositions, etc. But, of course I am not LK and have absolutely nothing to hide. And, I would have left Hawthorne Hill at the first inkling of bad vibes, so there’s that.

I don’t comprehend the behavior of the Kanarek family. Who does that?

I can’t imagine the trouble one would be in for making a false claim like that - actually I can - it just came put yesterday that Ashley Smithline, one of the parties against Marilyn Manson actually fired her attorney in April and he’s been pretending to represent her and making false filings all this time. She had to reach out to Marilyn Manson’s attorneys to correct it. Yikes.

They can and do, especially if there aren’t any procedural consequences to delaying the cases that get moved.

They are not beholden to many, and run their courtrooms as dictators. Benevolent usually, but dictators, none the less.

Edited to add: perhaps they are more like feudal lord’s who hear the petitions of their villeins

While I agree and very much understand what you are saying, I do think the fact that Barisone was proven to be driven temporarily insane by LK’s actions is very relevant to the civil trial. It’s detrimental to K’s civil case.

Also agree here. I think Schellhorn has moved on with life and cares very little about this case. They see a lot of cases and this wasn’t a hugely publicize trial, a landmark for his career, etc. He was also professional and sane with his behavior and seemed to acknowledge and accept the verdict.

Dictators is correct. Some worse than others.

And I have worked with, and am still friends with, many judges. Every single judge I clerked for has moved up to be a Supreme Court Justice. Suffice it to say, I know them, their foibles and their scheduling.

Agree in part. I have a gut feeling about Shelly though. I’ve known Court people to carry grudges, often petty ones.

Well it certainly gives him and his legal team a guide on how to convince a jury of that, so he can do it again.

Good thing he has some really sharp attorneys working in his best interest, as opposed to filing a request that would harm him.

A few of the pans over to his face while the State Psych was testifying made me think he was “all in” on the testimony that MB was faking.

Sidebar of sorts. Indulge me or scroll on by. I am 72 years old and have lived a long, productive, accomplished life in the business, and political and volunteer world as an organizer/leader. I marched on Washington umpteen times and barely missed being a Freedom Rider due to young age. I have never been arrested or detained for any reason whatsoever. My military family would have handled any mental, physical, emotional or societal defect I had PRONTO. They would not have enabled bad behavior and definitely would have jerked a knot in my tail for any noncompliance to a legally authorized court order.

I simply do not comprehend anyone thinking their behavior is above social norms. Money doesn’t buy a good reputation or grace.

I know I’m among many who can’t wait to never hear the name Kanarek again in any fashion. Until then, friends still need support and victory.

I am just going to ramble about something…I wonder, does JK have actual courtroom experience? He worked in the corporate world, yes? The reason I am asking, I work for the Office of Administrative Hearings in the state where dressage goes to die. I am basically the clerk of court, called something else, but that’s what I do. We recently hired a new judge, she has NOOOOO courtroom experience and is having to be walked through the process and knows nothing about the rules of civil procedure which this office follows. I know this is very basic, and I certainly am NOT condoning not responding in any way shape form or fashion to the subpoena, but could JK just not know he should have responded? Or had his attorney file a Motion to Quash??? Color me very confused. Thanks you Legal Eagles!!!

I feel the same way. After a long career in the Courts with 2 awards for Heroism (one awarded to me by top Judge in the State) and a continuing investment into a business in the equine industry as well as real estate, no arrests, warrants, summonses, excellent credit, I’m quite happy my folks instilled in me the importance of lawful clean living.

People see honesty when it exists but even more so they see deception and shakiness and they react to it. This is evidenced by the reception certain cases get in the media.

And thank goodness they do.

Oh boy! Was the judge elected? Typically they are political appointments or they are put to a slate for election by their party - meaning friends.

In the court world there is extreme nepotism for friends and family. There are “contracts” made - you do this for me - put this guy here and I’ll do this for you.

The Office if Court Management is then tasked with training the judge. And it better be good training. Plus the judge must put forth the word on their law clerk as today’s law clerk is tomorrow’s judge. It’s like a Conga line.

The judge better get proficient FAST. What a terrible predicament to be in!!

JK not responding is most likely just a play to see what he can get away with. Civil cases don’t usually breed jail terms. Maybe a monetary fine. But if there’s more to lose by compliance, he might see it as a viable play.

This was an appointed position, not elected. I am guessing there are political/nepotism ninjas at work. Where I work is a State Agency.
