And for the legal eagles - since Schellhorn is representing the State, he is tasked with presenting a compelling reason why “the State” believes MB is still a danger to himself or the public. And his reason has to be something more tangible than “LK is still afraid of him.” Correct?

It has to be based on medical reports from the State psychiatrist who is supposed to complete an evaluation within 5 days of the hearing.

Another thought, if the psych at AK already have all the evidence from the trial…and have been sent transcripts of the recordings by LK……then their decision would theoretically already include all that stuff factored in.

So, wouldn’t a victim statement be irrelevant?

Yeah, they’re supposed to get the discovery along with the patient.

Maybe that’s why the hearing is delayed. Someone in some office at AK is still reading the discovery.

My point is that provision “c” is enumerated as one of a victim’s rights. If the victim’s rights have been violated by “any person acting in support of or on the behalf of the defendant” the issue might come up in the hearing, whether brought up by the victim, or by the prosecutor if the victim is not permitted to make a statement.

I think it is extremely unlikely that Schellhorn’s office would pursue charges. Not all violations of someone’s rights are criminally actionable.

The Kroll hearing is closed “to the public”. Some key people other than psychiatric experts and officers of the court, such as the people who will constitute MBs support system upon release, will attend. It is not clear to me whether LK will be permitted to attend, but on this issue, it seems the prosecutor could raise this issue on behalf of the victim if it is relevant

So, you seem to be going down a VERY specific rabbit hole. One that is very similar to a comment LK made on YouTube on Saturday, July 16, in the comments portion of one of the Law & Crime videos from the trial.

Her comment was in response to a YouTube poster named Gail Cullinan.

I have a screenshot of the comment, but I am not going to post it to this thread.

The general gist of the comment though is that if a patient acquittee in a secure mental health facility was in touch with people outside of the facility, and those people were using FB and “other platforms” (presumably discussion boards like COTH) to “act on his behalf” … that this social media activity somehow constitutes “new evidence” that the judge and “psych facility doctors” will be shown during the Krol hearing, and that the judge and psych facility doctors will consider this “new evidence” when deciding whether or not to recommend a conditional release for MB.

It seems both you and LK are unclear as to whether or not it will be LK herself, or Schellhorn, who will be presenting this “new evidence” at the Krol hearing.

Bluntly… even if it was possible that a scenario existed where either LK or Schellhorn attempted to present this supposed “new evidence “ at the Krol hearing… I’m pretty sure such an effort would be met with a firm “OBJECTION!” by MBs attorney, as what 3rd parties say on social media about anyone involved in this case is not “new evidence” that has any material relevance to the question of MBs current mental state. The Krol hearing is about his current mental state.

Just calling that one as I see it.

Yes, and the key is current mental state.

There is nothing to be said that is relevant by the other two major participants of this situation. They are the ones who purchased a home a mere few miles from MB’s facility. They were not worried enough about the outcome of their action to leave Barisone’s NJ facility. They are the ones continously bashing MB and others for more than three years. As far as Barisone’s rabid supporters being a cause for concern, well, Barisone has had no contact with all these strangers so he hasn’t ordered any of them to say or do anything, contrary to an opinion. To a person ALL of the individuals directly involved with this event, including all the witnesses for the prosecution and defense have said absolutely nothing publicly…except for two prosecution witnesses. Seems to me any “statement” would be better served at the civil trials, assuming they aren’t withdrawn. The criminal trial is OVER. Justice has been served. It is well beyond time Barisone was released to his private physicians to resume treatment and rebuild his life and business.

Yes I did….because they are a reaction to the GFM updates on how well MB is doing. Seems relevant. Someone is doing an awful lot of work to tear things down online. There has to be a reason for that.

Maybe the hearing was delayed until the end of August because Schellhorn’s office has been busy monitoring social media for “new evidence” of people commenting and “acting on MBs behalf”, and then Schellhorn’s office will be sharing all this evidence with the doctors at AK, and they will all coordinate and write their reports accordingly, and then Schellhorn will use all this “new evidence” to make a coherent argument to the Judge at the Krol hearing at the end of August about how all these mean posts on social media by random third parties are CLEARLY evidence that MB has current mental health issues which make him an ongoing threat…

Or MAYBE that’s completely absurd on its face.

If LK is permitted to make a statement pointing out that in the three years since she was shot, people purporting to be his “supporters” have continued to victimize her on social media on a near daily basis, and neither he, nor his lawyers, nor his closest personal friends have asked these “supporters” to lay off, I wonder which way that will cut?

I have pointed out previously that while MB and those close to him have refrained from posting on SM, it appears that neither he, nor his lawyers, nor his closest personal friends have seen fit to encourage his “supporters” to lay off LK and let her live in peace and get on with her life. He’s obviously in touch with LO and his lawyers. I’m not saying he has activity requested via LO that his “supporters on CotH” trash LK and attempt to get her blackballed from trainers and barns. At the same time, Eggbutt has admitted that she is in communication with insiders in the MB camp.

I think LK has been subject to “intimidation, harassment and abuse”, at times extremely viciously, on these threads over the last three years. It was interesting to me that the NJ constitutional bill of victims rights mentions exactly this behavior as a violation of a victims rights. If all this activity arose spontaneously without direct requests from MB himself, does that make it OK?

I’m not this Gail Cullinan person, have not read her comments on “new evidence”, and I’m not saying anything about “new evidence”. You’re right that I don’t know whether LKs position as the victim will be represented by LK herself or by Schellhorn.
