Absolutely agreed. The amount of damage that her lungs sustained would make this virus truly life-threatening. Whether I agree with her choices or not, I absolutely do not wish her any harm.

Is there any news about the case other than that the next court date is in early July and Lauren is not sure whether Barisone’s side will show up or delay?

What is there to discuss other than Lauren showing?

I’ve only been involved in one US criminal case as family (victim side). Defense drug it out for ages.

Defendant was out on bail so it was a plus for them, but it was hell for us to have dates set and then postponement after postponement. Once I flew from Europe to be there only to have defense squirrel out at the last minute. (drunk driver killed family member; driver over 2X BAC; 6 PM, still light out; victim driving home from work; driver’s SUV crossed centerline and killed victim in small car, head on).

It eventually backfired on them as they wanted our ok for a last minute plea deal. And they had the face to ask for no jail time. Because we had been jerked around for over a year (there was no discovery, nothing tricky, BAC value had been in since Day 1, no contributory issues, police reconstructed the accident, no impairment of victim, defense wasn’t even contesting anything, they were just delaying to keep driver out and free as long as possible) we said no. We didn’t have final say, of course, but b/c we said no they didn’t get it. They did plead guilty and we finally had our day in court at sentencing.

No priors so they went with recommended minimum: 3 years. Killed him dead and driver got 3 years. Don’t think all was served, either. Oh, and driver’s license was not revoked until after the sentencing so they were driving around all that time, too. I’m a lawyer so I get that no premeditation is an important point and lowers the sentence but, wow. Killing someone and getting 3 years felt harsh from our POV.

I’m not a criminal defense attorney and I’m not even litigation, and he has a good lawyer I’m sure. But I would definitely not drag things out unnecessarily (beyond what’s reasonable for reviewing the materials from discovery) b/c it can really backfire on the defendant. Plus, it’s just crappy for the victim.

I suspect the defense is very busy preparing for trial by interviewing defense witnesses, subpoenaing medical, court, phone, and social media records, and basically dotting every I and crossing every T before proceeding. I suspect discovery in the civil trial gave additional information to be checked out. I doubt any stone will be left unturned in defending MB. And yes, from the potential witnesses involved it seems likely LK’s past will be a prominent witness all by itself in this trial.

It is hard to believe it has been almost a year.

Folks should realize that we are talking, here, about the civil case, not the criminal case. The civil case had announcements online. The criminal case gives no information out to the public, but might have info shared via reporters.

Note that as far as I can tell, the supposed ā€œtapesā€ don’t come into play in the civil trial. The civil trial hearings were postponed due to covid. I presume the criminal trial is also post poned due to covid, but no on knows.

Any comment that Lauren made about the trial, which was quoted in the first few posts of this thread is not made clear whether it was about the civil or criminal case. Two separate issues. MB has a civil case against Lauren, Several others have civil cases against lauren, and Lauren has a civil case against MB.

The state of NJ has a criminal case against MB. Lots to unpack, but not alot of disclosure from the courts.

Which case wasn’t specified. I assume LK would be involved in any hearing related to either trial, but LK specifically references the justice system, so I am assuming she meant the criminal trial for the purposes of the post.

Either way, I imagine there will be a lot of overlap since the both involve the same incident.

So, in the first thread LK accused MB, MH, RC, and JH of directly plotting to murder her and having it on tape. MB is in jail, and RC was charged with gun violations, leaving MH and JH with nothing and all of us all wondering where the conspiracy charges were for the accused conspiracy.

Now she’s saying two more people are going to ā€œget itā€ and the justice system is slow…I assume that is implying charges for MH and JH and added conspiracy charges for MB.

The criminal trial has been postponed as well, as it was supposed to start the week of June 14th before any motions to delay had been done. That is what the April hearing was supposed to be about, but that was cancelled due to COVID. As of now, there is no rescheduled trial date.

According to LKs Facebook post, there is a court hearing scheduled for early July, and her reference to the justice system suggests that it is a hearing in the criminal case.

IMO both the civil and criminal trials will be interesting to follow.

The courts in my state are talking about opening up with some virtual trials on smaller (and only monetary) matters. I really do think you have a constitutional argument regarding the ability to confront your accusers when a criminal trial is virtual–I doubt that they will do virtual attempted murder trials. I think this will be punted for a very long time…
