How long can a state hold a prisoner without holding a trial? At some point it could be argued that his right to a speedy trial has been violated.
But if it’s his team that are pushing the date back then there would be no issue.
Too bad it is true. Not the same thing as a stereotype. She has proven that herself. I am beyond tired of hearing people defend bad behavior.

I’m sure we could come up with some steriotypes concerning this:
“So, do we wear masks forever now? How many people are going to start having related issues because of extended wearing of a cloth covering over their faces? How many people are going to have complications we can’t possibly know about now because some people are insecure about this whole thing? At some point we need to move on.”
This is true, but I wasn’t necessarily referring to MB. I did mot mention him in my question. I suspect he is not the only accused person being held in NJ jails with the criminal court system shut down.

It could be conspiracy charges against RC and MH. RC has the gun charge, but I read LK (in previous threads) as treating RC and MH as central figures, but not JH.
I had the same reaction as Carol: you’re stereotyping “most of the people from NJ”, not just stating your opinion of LK. Many stereotypes have some degree of validity regarding a population as a whole, but I had not heard the stereotype of people from NJ being big mouths.

@FitzE or someone else can correct me if I’m wrong, but I think it applies only if there is zero movement on the case. For example if neither the defense or the prosecution is filing motions and the like. Hearings get postponed all the time, so as long as there is paperwork movement it shouldn’t be an issue.
There are some litigators and court staff on here who know this stuff cold. I’m just transactional, alas. But my super limited court experience (pro bono asylum cases in SDNY) suggests that this is correct. As long as things are happening it seems it can drag on indefinitely.
Off topic but relevant: Lauren finally, legitimately achieved her final Bronze Medal score this weekend. Good for her. She rode one of four classes entered and scratched the remaining 3 classes after her first ride. I understand this is standard behavior for her. Interesting.
Back to the trial topic, I doubt MB’s attorney will proceed until he has uncovered everything he can to defend his client. There is so much background to go through and that takes time.
She specifically named JH in the original thread and she has since accused him of theft of personal items in a follow up thread.
Theft of items from the house after the shooting is small potatoes compared to being charged with conspiracy in a murder case.
I was agreeing with your point that charges against two people for conspiracy may be what she was referring to. I don’t know which two. But just because RC already has a gun charge doesn’t mean she’s out of the picture wrt a conspiracy charge. In fact, unless her position is that Barisone got her gun without her knowledge, she’s the most likely person to get a conspiracy charge.
Did we ever see proof RC was arrested on gun charges? I just remember that information only coming from LK.
If I was shooting to get my bronze, and did so in my first class, I would probably scratch the others too. It’s hot, and everyone is just coming back, and there’s still a global pandemic.
I dont know why someone else scratching their own classes annoys some people.
FWIW my rider would frequently skip qualifying rounds if he had already qualified for the weekend gp. It’s really not crazy to save your horse from unnecessary exertions.
The defendant’s right to a speedy trial is statutory in most states and most state governors have tolled the right to a speedy trial in the face of the pandemic. Additionally, if the defendant is willing to waive the right to a speedy trial because, among other reasons, they want to have their witnesses in person and make sure they will show up, then the trial may be stayed. Additionally, the defendant has the right to a jury trial and if a state is on emergency orders or lockdown, they won’t be empaneling juries. They will figure out how to social distance trials soon enough and provide safety for the witnesses, juries, parties and court officers, but it is not now. There are rights that are affected by the inability to safely hold these things in person and the lack of procedures to do so during a pandemic. I bet there are plenty of scholars who are busy trying to figure this out as the jails fill up.
