I watched the plaintiff’s attorney’s opening for a few minutes and it was so awful I turned it off. Are you telling me the defense was just as bad? That poor jury.

The defense was worse. Neither of them can tell a story. The plaintiff’s lawyer kept having to raise objections during the defense’s opening. At one point, the plaintiff made an objection “Argument” (since argument is for closing - opening is for saying what the evidence will show) and the defense’s response to the judge was along the lines of “but that was a good argument, wasn’t it” 🤦

It is he said/she said, but he did sustain significant injuries. The question to be resolved is who crashed into whom.

Unfortunately for her, she’s been acting in a manner that is probably quite off-putting to the jury.

Yeah. He still has to prove she was 51% to blame.

Her lawyer is just as unlikeable as she is. I didn’t watch all of yesterday’s stream, but it was amusing that they complained about cameras filming her when her lawyer was speaking, considering she sits right next to him.

Do you think the judge may be waiting until after the mediation proceeding next week? See how cooperative everybody is first, then come down on whoever isn’t playing nice with others. And if by some miracle the suit is dropped or settled, he might not need to do anything.

That’s an interesting thought.

I don’t expect much progress to happen at the mediation… but we will see.

Lollypop must be getting anxious given her deposition is looming now, and she has no certainty on what rocks MBs team is going to look under, and what paths they might go down.

The article I just read said there is an eyewitness, but he was described as an “acquaintance” of the guy in the case.

In opening, both sides claimed they each had the only “real” eye witness, and both of the eye witnesses tell completely different stories. Its a mess.

I didn’t watch all of yesterday’s trial day, but the defense said during opening that the plaintiff either had a text or email where he said he had the incident on GoPro and that video is missing.

I agree… maybe the new attorney didn’t get the entire case file from Nagel? Or… maybe Nagel provided the complete case file to LK, and she didn’t turn everything over to GAS?

Gee, the Ks certainly seem to have a consistent problem with their lawyers misplacing things. Isn’t that why JK claimed his subpoena had not been answered? Eight months ago?

I think this is a very good filing by Mr. Deininger. He is basically saying - look, we have cooperated and already provided information when asked. Discovery is supposed to happen the other way and Lauren Kanarek and her side have not done a single thing that has been asked for but now they are demanding we do things…all while they are still ignoring that they are supposed to go first and have done nothing.

Well done Mr. Deininger. Well done.

Maybe they need to be introduced to “rolling up their sleeves” and learn what that means!

Maybe this is what happens when you cannot afford an attorney other than an ambulance chaser, working on compensation based on what the lawsuit wins???
