Oh and for the record: A landlord removing a tenants door to get them to move is illegal and is categorized as an Illegal Lockout.

Landlord/Tenant is one of the aspects of my job in law. Among other things, I issue eviction warrants for a living.

The hearing was a detention hearing to determine if he would get bond. He did not and must stay in jail til his case is heard.
We are waiting to hear of his arraignment hearing at which time he’ll plead guilty or not guilty unless a plea negotiation is
done in the mean time.

Unless he appeals the bail decision correct ? But seems like that will not happen.

You know this how, exactly? The people who have posted on this thread who say they know something about guns seem to be surprised that she is still alive with two 9 mm gun shots in her.

I don’t know much of anything about guns myself, but I would think if someone was trying to kill another person at close range with a serious handgun, the other person would be dead.

the main reason she isn’t dead was the hospital she was transported to Morristown Medical Center’s Trauma Center is verified as a Level I Regional Trauma Center by the American College of Surgeons and designated a Level II by the state of New Jersey.

with “2 counts of Possession of a Weapon for Unlawful Purpose.”

Sounds to me like HE brought the weapon to the scene.

From my understanding, the possession charge is because he had it physically in his possession to shoot it, not necessarily that it’s his or that he brought it. As it’s been said already in this thread, yes, he could have come down to the house with it, or she could have come out of the house with it and had it taken away.

She was alive enough to call 911 herself and was apparently speaking when the medics and police arrived. If she was intelligible on the phone, it seems likely that she escaped serious damage to heart, lungs, or throat.

I wasn’t there, I don’t know, but while it sounds very serious indeed to require surgery and be in “serious” condition, nothing about the report says to me that anyone was in any immediate danger of dying.

I was just reading up on plea deals and saw that 95% of all criminal cases are settled by negotiating a plea. So very few go to trial and if that’s the case here, we may never hear all the details about evidence in this case.

And according to what I read, most attorneys try to persuade their accused client to take a plea. Interesting to read the behind the scenes details about this. Attorneys say cases where there’s a plea deal are easy money vs. going to trial
which is loads of time and work and most criminal defendants don’t have the money for a trial.

The prosecution would probably love a plea deal because if they put LK on the stand everyone will see what a whack job she is and it will not help their case.

Initially some media reports said she was hit in the “heart and Lung” and she was semi-conscious when LE arrived.
Remember many times shot victims do not bleed out right away and they can speak, just like Megan Betts in the Dayton Ohio massacre told someone next to her to call police, I’ve been shot. Then she died.
Also LK’s family confirmed she was shot in a lung and had surgery for that.
I don’t think there’s any doubt she was seriously wounded.

LK subjected MB to sustained harassment and psychological abuse. If you beat a dog long enough, dont act surprised when it eventually bites you.

The poster who told the whole story in a gender swap was absolutely right. If a man was harassing a woman, calling ICE on her, living in her home and refusing to leave, threatening her family, jeopardizing her livelihood, calling dyfus, screaming “I’m going to destroy you” outside her bedroom window, and god knows what else… there would be outpourings of sympathy for her.

would I have shot her? Probably not. I will tell you though for sure, if some woman did that to my husband she would have gotten one or more brutal ass beatings (by me) long ago.

But the way it looks, MB went there to confront her/them and with a gun and shot her twice in the chest. If he were fearful before he shot her, he would have retreated, got back in his truck and left. Or never have gone in person at all.

In the eyes of the law chest shots are meant to be lethal. Two shots guaranteed lethal (in the shooters mind).

Again, MB grabbed his gun, got in his truck and went to them. He was intent on causing serious bodily harm in the eyes of the law.

Again, you’re speculating without facts. It was HIS residence, not theirs. He may or may not have been alcohol impaired, or emotionally distraught, or who knows what - but YOU don’t know his intent. You are inventing facts to support your ideas, and that’s it.

A few things working against MB IF he went to trial- He took a gun with him to confront both which shows intent/planning.
Also he shot her not once but twice, again showing intent to kill, and where he shot her in the upper chest vs in a limb or lower torso also shows intent to kill. He went there intent on killing her. This seems like a slam dunk to me.

But if he pleads, he supposedly has no recent criminal record, and would have to plead guilty probably to a lesser crime and he most likely will have some jail time. How much is anyone’s guess. My understanding the state atty. discusses this
with the arresting LE and the victims before suggesting the plea.

I haven’t seen an arraignment announced so don’t know when that will be.

So you were there? What color was his truck? What was he wearing? O yeah, that’s right you weren’t there. We’re only hearing the story from 2 people that have a less than credible background. It’s not been actually said other then those 2 people but he is the one that brought the gun. He may have brought it for self defense because she certainly is scary and from her Facebook page obviously could be a threat. She could have come at him with a knife, there could have been a struggle in which case the gun would be in between them and right at her chest.

Isn’t it possible he went there to confront her, she came out with HER gun and then as a 120 lb female wrestled with a 6’4 fit Male over possession of the gun she got shot?

Not saying it’s PROBABLE. Am saying its POSSIBLE.

Also the judge was inappropriate when he spoke. He stated that MB brought the gun to kill her.

It was a bail hearing. MB has not been tried, there is no finding as of yet. The judge needed to say ALLEGEDLY.

Because that’s what the witness statements / police reports released to the media said, and because that version of events was not disputed in court by MB’s lawyer.

If she had the gun then she refrained from shooting him and he was able to wrestle the gun away because she did not empty her weapon center of mass. Little woman/big man. Once he got the gun away from her, why did he put two in her chest at close range and one through the window where boyfriend was? Then wrestled with boyfriend until boyfriend got the gun away. Boyfriend does not shoot anyone even with girlfriend bleeding out on the ground. She is injured so badly, they have to do procedures to help her breathe and at some point she was in a medically induced coma, which is really confusing to me if that was before or after she could communicate. She has one in the heart and one in the lung. That tells me they are not using hollow points. A pink Ruger 9mm could belong to several women affiliated at the barn. His fiancee’, his ex-wife, women trainers, or him, maybe he thought it was cute to be all 6’4” and have a pink handgun. So we know neither girlfriend or boyfriend have an intent to kill or MB would have had a full load of bullets center of mass from when he walked up to her if she had the gun and wanted to kill. Some of y’all may not like her but one person used that weapon to try to kill and it wasn’t her or the boyfriend. LE arrives and finds little bitty thing bleeding out on the ground and boyfriend and MB hurt and boyfriend only holding him down. It’s irrelevant whose gun it was. Only one person tried to kill with it. She isn’t out of the woods yet. If she dies, it changes from attempted murder to murder. They are not going to plea this one out. It’s a violent crime. Also, if you kick someone’s ass, unless they attack you first, it’s assault. Don’t go there. Are you living in a honky tonk? Just no. This is awful. Little kids look up to olympians and dream. This has been a bad summer for equestrian sports.

Was the one court hearing they’ve had really a time to do that though?
It seemed it was not likely any argument was going to sway or change that he would remain in custody.

Also, though I’ve not had a chance to watch it myself to judge, many have suggested his lawyer is not really up to the task. Could that be why he didn’t argue those facts?

Actually, I believe LEO arrived to find Fiance on top if MB who was on top if the gun. Very different from what you are describing.
